If your account of the incident is accurate, and I have no reason to doubt it, then it would appear that the police officer asked you for ID and you failed to comply 3 times. I believe that police do have the right to ask for identification - in NY, anyway. A refusal might constitute an infraction. Before I'd fight it, I'd seek a legal opinion. Despite the reason for the request, your refusal may have been illegal under the law. |
