Not quite as simple as that. The courts have overturned stop and identify stautes that allowed requests to be made when there was no crime suspected. California's staute was one of the ones that was overturned. It allowed ID requests even when there was no crime committed.

The supreme court was very split on that case. It would seem that I actually have a much better case than the Hibel guy did. He refused 11 times to show an ID. I had a 20 second conversation and never technically refused. They also said that he really had no legitimate concern that giving his ID would harm him. Since my information could and would be added to a terrorism suspect list, I had a legitimate concern.

Still even though every deputy said that the only thing that I did wrong (including the one that stopped me) was that I refused to offer my ID, I was cited for unruly behavior. I wonder if that was to cover themselves. When I was speaking with the commander I noticed them huddled together around my stuff. I think that they were looking through my photos (I know they were a few minutes later), but they may have also conferred on what offense would be the most appropriate.

Either way assuming that the truth is told by all parties, I'm starting to like my chances for contesting this citation.
