You need to reread the case. Your conclusion is false.The Supreme Court said that a refusal to identify oneself to an officer in the context of the officer's having reason to believe you may have committed a crime is an offense. Reread my post. If I am walking around with no identification on me, and the officer stops me without suspicion of a crime, he has no authority or basis to arrest me. Arrest purely for lack of identification is still unconstitutional. |
