As has been mentioned several times in this thread it was to decide whether or not the Nevada law allowing law enforcement to ask for identification if they suspect that a crime did, is, or is about to happen. It doesn't have to be a felony. Also the courts had ruled before that case that stating your name is sufficient for identification. You do not have to show identification. You do not have to give your address. You do not have to offer any more testimony other than your name. You can google "stop and identify statute" for lots of info. This one is pretty thorough and there are lots of legal sites if you prefer. http://policechiefmagazine.org/magazine/index.cfm?fuseaction=print_display&article_id=382&issue_id=92004 Now, some guy walking down the street scratching his ass... no, in general he doesn't have to have any form of ID, in most jurisdictions, unless a so-called vagrancy law exists. I'm not sure these have ever been challenged in court. Look on those cites and you'll see that the original vagrancy ones were overturned in 1972. |
