You can tell the judge that since you were in no way engaged in an illeagal action, that you did not expect to be stopped or questioned by an officer. While an officer does not have to answer your question, the officer's statements requests and questions to you were quite improper, and may be seen as such by the judge. Especially as you have written them down carefully.The officer's third request should have been: "The law requires that you show me identification at this time." Once an officer makes contact with a person, a contact report must be written, either a summons or a note in his book. Me thinks it would be helpful to have a micro-recorder in your pocket that can be switched on when needed. Most Sheriff/Police agencies already do this. Usually the cammera in their car does this for them at traffic stops. The officer *was* unprofessional, and this needs to go further. The worst that can happen is the judge will make you pay the fine. Most likely, he will let you off. ROAR™ |
