Hunters Point vs LIRR Round 1 |

Posted by Doctor B on Wed May 20 23:21:15 2009 The following post appeared today on the Queenswest Forum:"We're petitioning to ask the LIRR to turn off their diesel engine trains, or find a way to move them away from residential areas. Your support is greatly appreciated! I was waiting for this battle to begin. Condo towers are built across the street from the LIRR LIC Yard on Borden Avenue. Apparently the new arrivals failed to notice there is an active railyard next to their building. It has been there for over 140 years. We know DE30's idle every weekday. The railroad will give you a detailed explanation why they can't shut them off. Heating/cooling/computers, I've heard this before. MNR avoids the situation by utilizing house power at Wassaic. LIRR doesn't bend for anybody. |

No one was complaining when the M-1's ruled the LIRR. So essentially the LIRR snuck in new equipment with louder horns. Is this the peoples fault for complaining? Instead, the FRA should design a newer style grade crossing 'gates' that actually prevent pedestrians and motorists from circumventing the lowered crossing gates. The current style crossing gate may be good for farm country in the mid west but is not suited for densely populated suburban areas. Bill "Newkirk" |

The DE30-powered trainsets idle every weekday from about 8:00 A.M. to 5:30 P.M. There's nothing in the yard at night or weekends.People come to look at condos in the area on weekends, when there is no train traffic and the streets are empty. Sales agents won't say, "Hey, on weekdays this area is a very busy transit hub". Crowds at the Vernon/Jackson 7 station, Midtown Tunnel traffic jams, and the LIRR activity. New tenants probably flip out their first weekday morning in their expensive new apartment. |

New York State is a state that practices "caveat emptor" which means "Let the Buyer Beware". It is up to the BUYER to research where they are going to live and the surrounding neighborhood. It's their own fault if they "didn't see" the train yard, and it's a little yard to miss. And it's been there almost 150 years. The condos weren't. It's their own fault if they "flip out" in their new apartment. |

Sounds more to me like they felt that they got the short end of the stick, so they're going to try and undo the transaction. |

I don't know for sure in idle mode, but the GP38's roared a lot more when running. I used to be able to hear the GP38-2's from my house reving up when they were starting up at the station, and the station is about a half a mile away from me.I remember standing on some stations like Oakdale on a summer evening when the Montauk express westbounds used to go by, and those things SCREAMED as they went by. |

But the petition described in the original post here in LIC concerns action that unit owners demand that the railroad take. Very different situations.In the event that some fool unit owner wants to bring an action against LIRR that the railroad activity constitutes a nuisance, I suggest that we give the ideas of Guido Calabresi and Douglas Melamed's classic article a whirl, with a similar approach taken here. If you want to call it a nuisance, since you came to the nuisance, indemnify LIRR to shift operations so as to abate the nuisance. So they can pay for LIRR to electrify, or take other measures! |

The yard was there first, they aren't doing anything different than when the condo people bought their units. In NY state it's "buyer beware". If they didn't do their research before buying, that is THEIR problem, not the LIRR's. And I am SURE these condos, even if "luxury", are still cheaper than other condos that are similar in a neighborhood where there is no train yard.I have no sympathy for people that buy something cheaper than some better location, and then expect everyone to bend around them. |

I can tell you, having grown up 9 blocks from Runway 13L/31R (pronounced ONE-THREE-LEFT, THREE-ONE-RIGHT in aviation lingo, and all subsequent runway references are to be interpreted as such), from 1981 to 2001, I can remember every Concorde, both British Airways and Air France, who had 2 times-a-day departures each (0800 and 1300 approx. for Air France, 0900 and 1400 approx. for British Airways), and 2 times-a-day arrivals each, I know about noise, and I mean true, foundation-shaking noise when these bad girls took off from Runway 22R about 2 miles away and generated a shockwave with the thrust of the afterburners (attached to powerful Rolls-Royce Olympus engines) or 31L towards Howard Beach and Canarsie. And about smells, try smelling for 4 - 6 hours the "sweet smell" of jet fuel from idling planes in a winding taxi line all awaiting takeoff on Runways 13R or 22R, both really close to where I lived, not to mention the added smell of the arrived jets, and also when the winds were out of the southwest direction, the smell of the then-Spring Creek/Starrett City landfill and the sewage treatment plant at the extreme west end of JFK, and the nicer smell added in of polluted Bergen Basin at low tide.....now all that is true smell!! Screw the sounds of DE/DM30s idling being loud, or diesel fuel reeking worse than what I smelled out by JFK!! I would take those and Nathan K5LA toots over being another second next to JFK Airport, hearing it and smelling it, any day!! |
