now people get arrested for anything even for Finding a wallet on the floor to money. Remember when the cops started to Trap people by putting wallets and julery and money on the Floor and if someone Picks it up you get Fined or arrested.

I sometime ask the officer if I could take a picture if they are really close by the spot to take picture.

Sometime cops are cool with you but it depends how cool you are with them by not argueing or talking bad.

Remember depending on your actions is the way a cop is going to treat you. alot of cops are trained to be assholes.

The LION made a booklet of his pictures and layout.

A REAL (harmless) foamer would be all over the cop showing him his album of fine work, bore them to death with R-numbers.

The last pages of my little booklet had copies of the rules and other information. I have spare copies of my book and am happy to give them to the cops and others.

Last trip to the city A couple of cops spoke with me (I was called in by the T/O but then I was taking photos through his cab to the RFW to make some time exposures of tunnel lights. Show your great work to the cops, they will get bored and want to be rid of you as soon as possible.

If you want to see or download the booklet .pdf Remember that it was intended to be printed on each side of a 11x17 page and folded down to its proper size.

Almost cetainly the assumption is that the SCA-types might have connections in high places which might make life difficult for the cop. Those of us who do not fit the SCA profile are fair game, though, as we do not appear to have access to the resources or influence necessary to make a cop think twice.

I wonder how an SCA-type would actually behave if he was forced off a train, had to sit quietly while the cop asked him if he'd ever been arrested before, and ran his name through the system for warrants. I'd like to see if such a person would get arrested for Contempt Of Cop...because I seriously doubt if an SCA could obediently keep his mouth shut if he were stopped for a minor infraction like passing between subway cars...

I had no problems when I was in New York last month. Come to think of it, the last times I had anyone tell me no photos was in May of last year. In London, a station employee on the opposite platform said photography was illegal. I apologized, walked to the far end of the platform, and proceeded to photograph from there. (I also had at least one instance where an employee came up to me and asked to make sure my flash was turned off but said that my photography was legal, and other posters on here have reported similar incidents.) A few weeks earlier, in Rome, a security guard told me that photography was illegal, so I apologized, told him I wouldn't take any more photos, and went on my way. Turned out those would be my last photos of the day, not because he told me photography was illegal, but because I was done railfanning for the day before he stopped me and just continued with my plan to get back to my place.

"Operation Lucky Bag" is currently the subject of several court challenges, because merely picking up a wallet or bag is NOT a crime. IIRC, you have up to ten days to either turn it in or place it in a mailbox. As an alternative, if you discover identifying information in the wallet or bag, you can return it to the owner yourself.

For a crime to take place, the cop has to actually see you pick up the wallet and remove cash or credit cards from it.

Once my father was caught speeding. He thanked the officer for stopping him.

As I see it as soon as a cop says that photography in the subway is illegal he/she is wrong. There is no other side to that part of the story.

Actually, even to a right-winger like me, putting someone in handcuffs over a photo rule infraction is a bit much, a summons would have been enough. But rtype3995 should NOT have posted the officers names/badge#s either.

Maybe subway/rail/bus photographers should carry around a copy of the MTA's photo rules.

In an infamous incident in Philly, the cops beat up three photographers and arrested them for assault & battery on a police officer and resisting arrest. At their trial, even the Police Commissioner testified against them. Dozens of cops perjured themselves.
What they hadn't known was that there were four photographers. The fourth had videotaped the whole incident. Upon viewing the tape, the judge threw out the charges against the photographers. The cops and DA were livid because they didn't get convictions. None of the cops was arrested or charged for assault & battery, perjury, or anything.
I suspect justice is similar in many cities.

I've had 2 run in with the fuzz in the last couple of years. One only asked to see the pics. The other tried to bait me into a verbal exchange sighting photography is against the law. And this person was from district 12. That was 2 years ago.

That really says it all, doesn't it? The cops think they can not only enforce the law but make it up.

They're wrong of course. Good luck with your lawsuit.

And, by the way, telling a cop you think he's wrong isn't disorderly conduct. The cops think they not only can make up the law but that they're entitled to deference and politeness as a matter of law. They're wrong there, too.

I think it's time that some of you rail photographers get together and head down to Freeman St station and start taking those all important photographs and teach these assholes that it's not nice to screw with a transit buff and take JayZeeBMT along to make sure those two dipshits are there, safety in numbers is the name of this game. You really gotta feel out the situation, and use some finesse. If the cop is seriously the prick of misery, there's no point in beating up his fist with your face. A reasonable cop will listen and once satisfied that you're a guy with a positive connection to society, will bid farewell. I've encountered both, and have a set of rules for each. I do carry the printed memos, rules, etc so there's something to look at. One thing I do though, even if I'm beating a strategic retreat, is to protest.

I have some rules of thumb that seem to work.

- If I see police I go over to them rather than wait for them to come to me.

- I call them "officer" just like I call others "conductor" or "doctor" or "bartender". Well that last one is more nostalgic ;P

- I point out that I'm not with the bad guys.

- I tell them what I'm after today, like that there's F trains running on this A line or there's a museum train running on the line, or just that it's Smith-9th, a postcard view.

- I carry the rules in case there's debate. I use the same terms I use with clients, like "I'm going to politely disagree" or "I differ with your interpretation" or whatever. There's no point in getting in the guy's face and if he is a prick, I just leave and come back later. There's no such thing as a victory with an officer other than if he buys you a beer.

Now, I suggest an immediate call to the ACLU and the retention of legal cousel.

PRECISELY the correct answers. I come from a family of cops, have dealt with strangers, and have never had an untoward outcome or a visit downtown unless I was invited and wanted to show up. :)

Not just the NYPD but sue the officers INDIVIDUALLY as well and very likely in FEDERAL court for civil rights violations. I had an incident (non transit related) with a police officer once where I threatened to sue and his attitude was basically "go ahead, the city has a lot of money." If these officers were compelled to realize that their fancy homes in the suburbs and their fancy cars coulod be taken away from them, they wouldn't act so arrogant.

I would think that denial of a trial in the absence of paying the fine first would be blatantly unconstitutional.

Why not send a letter to the Daily News or other NY paper with a short enough description of the incident and with badge numbers included so that the public will see who the individuals who are passing for officers are?

Nobody is forcing anybody to become a police officer. There are various motivations for people wanting to get "on the job" but unless an individual wants to be the best law enforcement officer that ever existed for time immemorial, he/she shouldn't even THINK about a career in law enforcement.
