Taking photographs goes beyond "no expectation of privacy". You can look at me or listen to me all you want. The minute you start recording my presence there though, you've exceeded your grasp, even if it's "legal" to do so. It's a matter of respect. It can even be frightening to some folks when they see some yutz walking through the car pointing something at people. The inside of a public transit vehicle is not the equvalent of a public street. If you want to take shots where there are people in close proximity the proper thing to do is to publicly announce to them your intentions. Nobody bitches, snap away. If you ain't willing to do that than one day someone will show you how wrong it can be take unwanted photographs. That's all I'm saying. |

I live in Manhattan, which happens to attract a lot of tourists. They happen to take a lot of pictures on public streets, and a lot of random bystanders unavoidably end up in a lot of those pictures.Not once have I heard anyone publicly announce their intentions beforehand. If I'm in a public setting (or visible from a public setting), then somebody might take my picture or jot something down about me. Chances are that I don't even know about it 99% of the time. Such is life. There's nothing wrong with it. |

Just waiting for something, anything to set them off.Most people don't care what type of car it is, or the signage, or the fact that it used to be another train route, or any of the stuff we focus on. They are going places they have to. We forget that at our peril. I saw a guy who was taking some pictures on the D train get knocked to the ground between Prospect Park and Seventh Avenue once, years ago. It was on a Sunday night. Screwball used his flash to take the shot. He was pointing the camera down the length of the car and this dude a few seats down jumped up and said "F***in' a**hole whuthef**k're you doinmotherf***er?!!!" He pushed the photographer hard and the guy was just laid out on the floor. His camera got busted all over the floor. I'm not saying that it was proper for that dude to hit the photographer. But that's what can happen. Do what you want. |

Maybe you don't see a difference but I do. Just as you can smoke on the street but not on a train, or sleep in your home but not on the street, a public transit vehicle requires some slight variations on the "...but it's legal on the streets!" elements of our civil freedoms.On the trains we ought to behave in a more polite fashion. Taking direct photographs of people without their permission is just rude. This is my personal feeling on the matter. |

In fact, it's even more "public" to ride the subway than it is to ride "Splash Mountain". When I'm going to take a pic of something inside a subway car for example, I make sure no one is around the area of the picture b/c I would want the same thing by not being in it, especially so close. I know that Richard didn't mean much by the lady & 2 people getting in the pic but again how would I know if someone were trying to take a pic of me for malicious intent? You do have those type of people, unfortunately. I too would most likely confront the person [I have run into situations like that before]. |

For you to comply with your own statement you would have to ask every person standing in the front of the trains "can I shoot it"? The look on the lady's face is WTF and the fact it is on the internet does little to bolster your argument. Passengers have a reasonable right to privacy in public transportation. You can't compare a commuter or subway train to a tourist attraction. When you ride rollercoasters nowadays you are prewarned of the videos and stills being taken when you are about to crap your pants. Your right to take a photo does not in any way allow for you to harass passengers in order to acheive the money shot. Most photographers give advanced warning before shooting when they are located by crews. The camera presense is enough for a motorman to shield his/her face and most are not caught off guard. Being you used a cell phone due to the crappy composure, she got little warning. Taking her picture in this instant IMO constituted aggrivated harassment. If you are trying to protest the proposed ban or highlight the degrading quality of service, this is not the way to do it. A letter or phone call with appropriate car numbers dates and times usually gets to the right departments. |
