But I suspect that it would be harder to effect change within NYCT, and would solve less of the immediate problems, than dealing with how the NYPD treated Nilet. Assuming your version of events is accurate and that you did nothing that would be hazardous or illegal (ie trespass or use flash) then you have grounds for a lawsuit and monetary damages.You also could ask a lawyer if you have grounds to obtain a restraining order or injunction, which would be signed by a judge, ordering the NYPD and TA to not interfere with your picture taking or video in any way. I am not a lawyer, so I don't know if that's possible to do, but I imagine it could be. Goo luck. |

I didn't apologize specifically, but I agreed to leave. They later chased after me and deleted them then. Incidentally, my parents just suggested right now that their main motive was to delete their own badge numbers from my camera. I don't know whether this is true or not, but it's a theory that they suggested. Since I'd recorded their information on my camera, perhaps they thought they could get away with deleting it? I checked my camera immediately after they gave it back and then chased them down again to regain their badge numbers. They paused briefly to let me recopy them. Perhaps they figured they could get away before I realized their badge numbers were deleted but didn't want to push their luck by directly refusing to give their badge numbers when asked? It's an idea, though it's unconfirmed at the moment. |

If you're gonna sue, talk with an attorney, not SubChat. If you intend to sue, you have work to do. You have more than 24 hours to deal with this so there's no need to rush (but don't shilly-shally either). Make sure your documentation is in order, like your notes regarding the incident. Organize all your pertinent data and if you don't have stuff like badge numbers/names, don't worry, as an accurate time will mesh with the officers' report for that time. You may want to set that flashcard aside until you hear otherwise from counsel; it may not make any difference but it wouldn't hurt to err on the side of preserving evidence. If you don't intend to sue, you'll probably still want to file a complaint with the NYPD and contact the ACLU. Putting you in cuffs puts this over top. Others here, like Bob Anderson have experience mounting a challenge with the ACLU so you may wanna ask... First off, I've had my own encounters with the cops (although not photography related), so I know exactly how you felt and it is a damn shame that you had to be put through that.Secondly, its a good thing that you managed to get the cops badge numbers, as that means you could positively identify them later on in case you decide to launch a civil action against them, the Dept., or both. What I would also do is to get the time, the order of events, and the locations down cold. Thirdly, when the opportunity permits, I would seek out an attorney, either ACLU or someone else (within your budget, of course). If you decide to retain whoever you find, be sure to relate all of the facts to them as they happened - they will figure out what can and cannot be attacked about the officer's actions at that point (and trust me on this: they might find that it was not one thing but something else that is implicated by those officers' action, depending on what you tell them). Oh yeah, and do file the complaint against the officers. |

I told them I’d like to record their badge numbers (on my camera, since I had no paper; I told them I’d cover the lens if they wanted) and recorded numbers, then proceded to walk out to the shuttle buses. As I was leaving, one of the same cops from before came up, told me to wait, then handcuffed me and ordered me to sit on a bench. Her partner followed and stood nearby while she took the camera away and out of sight.It appears that asking for their badge numbers ticked them off - up to that point you could have walked away unscathed. Carry a pen and paper and try to remember the badge numbers till you can write them down. I know its legal to ask for badge numbers but this method avoids some of the immediate confrontation. Then you can file complaints with the ACLU and the CCRB... The ACLU is quite interested in cases of photographer harassment - don't let this drop. |

I don't think you have a case as you have no actual proof of being handcuffed and having had the camera taken unless you got some names addresses and phone numbers of witnesses. You see there is no arrest record, or any record (unless one of the cops wrote up the incident) and you will need something besides your word against theirs. Sorry, that's the way it is. Did you get any names and phone numbers and addresses of independent witnesses to the incident? In that case, you could sue. Otherwise, you're SOL.Sorry to pour a cold bucket of water on the lawsuit happy brigade here. |

In the amended complaint filed this morning in United States District Court in Manhattan, the NYCLU alleged that NYPD officers are unlawfully detaining photographers and threatening them with arrest if they will not destroy their images or show them to police officers. Contact the NYCLU and see if you can be added to the list |

Since you were able to obtain the badge numbers of the cops, you should file CCRB complaints tomorrow morning. Be aware that even if your complaints hit brick walls, just the fact that they're on file can hurt the promotion of officers. You should also tell your story to Sam Unger at the NYCLU. The organization has spent over a year compiling similar stories for a much larger lawsuit against the NYPD. Even if the group can't help you personally, they might be able to lead you in the right direction should you wish to proceed with your own lawsuit of some sort. In this case, it's worth considering. Based on the story, a number of your constitutional rights were violated. |
