I'd like to have the right to eat on the subway without having the right to drop my garbage in the car or on the platform, but I can also understand the reasons behind a proposed ban. |

He clearly doesn't recall that hot food used to be widely available for purchase within the system. Back then, the rats/trash problem wasn't as bad as it is now, IIRC.In fact, I liked it better when I could get a hot dog and Orange Bang while changing trains, and there were always bins nearby for me to dispose of my trash. Hmm, could it be that removing those trash bins is part of the problem? |

If you allow people to eat on the subway, you get some inconvenience, a bit more litter, and a slight uptick in the number of track fires if the MTA can't be bothered to vacuum regularly. If you allow gun ownership, people get shot and die en masse. Obviously, there's a lot more reason to ban guns than to ban subway eating. |

Gun ownership is a privilege that you must affirmatively prove you need and can be revoked at any time. It's true that the US is extremely lax about actually restricting this privilege. It's also true that the US has a disproportionately high murder rate, attributable entirely to its refusal to restrict gun ownership. |

More importantly, as Plessy makes clear, what is decided in one era, can be reversed in another. Arlen Specter liked the phrase "stare decisis" but was also co-author of a manual on how to continue abusive interrogation techniques despite Miranda.Rail content--Plessy was a decision specifically involving accomodations on passenger trains. For many years railfan publications employed the euphemism "divided coach" when describing the Jim Crow cars in train consists. For those of us of a certain age, De Blasio v Cuomo is very similar to Lindsay v Rockefeller--in each case supposedly of the same party but personally not inclined to cooperate. Bill may not be perfect, but Lindsay was the last Republican I voted for and I doubt that will change in whatever time I have left. |
