Even though he is impersonating an employee in order to gain access to a restricted area so he could pose for a picture?Being in the restricted area is clearly a criminal act - trespassing. Who says impersonating a non-police MTA employee is a crime? No one has cited anything in the criminal code about that. It might be a crime, but I personally doubt it. I suspect it's only the thing you achieve through the impersonation (trespass, fraud, whatever) that's the crime. |
