Note the phrase "otherwise cause another to act in reliance upon that pretense."If he were to wear an MTA uniform to a Halloween party it would probably not be an issue but in a motorman's cab he is causing others to act in reliance on the pretense since he is causing them to believe he has the right to be there. |
