I imagine that some LIRR riders (not from the Port Washington Branch) destined for Lower Manhattan will try to use ESA to save time, but once they discover how deep the ESA terminal is, they should change their tune.First, the downtown 4 and 5 are already crowded with people from the Bronx, UES and MNR. That alone should change their tune. Both Penn and Flatbush have six lines each going to Lower Manhattan. Second, will it really save them time? My guess is no. |

Our politicians are the ones that fight...or don't fight for what we want. If we want public transportation, we vote in officials that will vote for it. We vote in our politicians, so we are responsible for what they do. So if the politicians we vote in, side with people that side with people that come into a neighborhood expecting the railroad to bend over backwards for them, then yes, it's very relevant. Most liberal politicians would be all over backing up the NIMBY's in this case. |

Is the right-of-way wide enough that they could build extra tracks to allow subway and freight operations to be on separate tracks? Rapid transit on Lower Montauk would be great for so many reasons. If money were no object and our politicians actually had some will, I'd propose running a new subway line from Jamaica along the Lower Montauk line, then run it into a new tunnel under the East River and 34th Street, terminating at 11th Avenue. It would connect to so many subway lines in Manhattan, the PATH train, Amtrak, NJT and Madison Square Garden, the Empire State Building, the Javits Center, etc. I really think that's something well worth considering. Way better than closing it down completely after ESA opens. |

Who said there was one to begin with? Why even bring up the specter then, if there is no such judicial decision that motivates your fear? I'm not Hillary Clinton That's too bad; it would be more fun to debate her! I do not subscribe to organized conspiracies. But you believe in disorganized conspiracies? What I do recognize (something you conveniently ignored) is that a single judge, with the flimsiest of grounds can grant the "residents" everything they want, immediately. You have already stated that there is no judicial decision on which to grant the residents what they want. Again, what are these "flimsiest of grounds"? There either is, or there is not, judicial decision on point. I have shown that there is not, you concede that there is not, but you seem to reserve some other "flimsy" grounds on which judicial decision could be based. It's hypocritical of people who vote for the politicians who are pre-disposed to ruling against the LIRR to complain about court action. And here is you error: politicians don't "rule" - that's for judges. You are confusing, as I said earlier, politics with law. Perhaps this is revealing about your own conception of what judges should do (i.e., enact your favored policy positions into law). You merely repeat the same error in every post. The only one complaining about the specter of court action - without citing any basis for this irrational fear - is YOU. My posts against you have noted that your fear is not well founded, or even rational. If LIRR officials decide to shut down the yard, that is their right. It is not the result of anything judicially mandated; it is a political decision. |

I see that in this second version of the post that I just responded to, you caught yourself - this time it's not politicians that rule in cases, but the judges that they appoint...Judges need grounds on which to decide to cases. Other judges supervise them (first appeal is as of right). I have been in and around litigation for several years now, and I can confidently say that you don't just walk into court, complain about a nuisance that's been there for about a century and a half that you just moved next to, don't even address all of the cases against your position, and the judge grants your injunction against the subsidiary of a public authority so that they can relocate operations of the largest commuter railroad in the country, patting you on the ass on the way out. When you know more about property and tort law, then I'll consider your opinion more informative than it presently is. |
