Oh, you're talking about SS disability. I thought you meant SS retirement benefits.My wife was a SS disability administrative law judge for about 18 months. These judges heard appeals from people who were denied benefits. She told me that a good percentage of these appeals were from people who were fraudulently claiming a disability. Don't believe anyone who claims they're receiving SS disability payments unless you've seen the checks. It is VERY difficult to qualify. |

We have clients whose pension plans only grant a disability benefit if the participant qualifies for Social Security disability. And there are plenty of people who stay alive receiving that benefit from middle age to retirement age (65). On the other hand, a lot of claims get denied, so I wouldn't say it's easy either. |

For SS disability applications, the applicant must provide medical records attesting to the alleged disability or other issues meeting the SS definition of disability.The state of Massachusetts itself doesn't offer disability benefits. The Massachusetts Rehabilitation Commission examiners and medical consultants determine eligibility of Massachusetts applicants for two disability programs: Social Security Disability Insurance (SSDI) ages 18 - 65, and Supplemental Security Income (SSI) ages birth - 65. |

SSD staff are, in fact, trained to deny as many claims as they can. As I stated before, I've known amputees, paraplegics, and severely bariatric patients whose initial claims for disability, were summarily denied. All of them had to hire lawyers to get approved.Denial is, a number of people have told me, the default position at SSI/SSD. The only claims likely to be approved on the first attempt, are life-support patients (such as those receiving kidney dialysis), or people suffering from major mental illnesses. |

Unfortunately there are too many ALJ's who are willing to rubber stamp the initial determination. One of my past jobs was for a firm that represented SSDI applicants in Federal Court and there were some Judges who you would not expect to actually care about the plight of the little guy versus the government who were excoriating Government attorneys over the conduct of Social Security employees with pro se litigants usually regarding "treating physician" rule and failure to develop the record. There was one case that was so extreme that the Judge was not even willing to let the same ALJ get a crack at correcting. |

This will turn your tapioca - there is such a backlog of SS disability appeals (over 1 million) that SS is planning on letting staff lawyers who are not judges hear and rule on the appeals. Current SS ALJ's will be grandfathered in but no new judges will be hired. Don't know when this is supposed to begin. |

Use your resources to investigate those that on their face have a colorable claim. |

Sports coaches running midnight basketball so young people have something to do. That was a very successful program that never should have been terminated.
