Lets say Hillary wins in 2008. Could Bill be her VP?

If so, it would be interesting, since if something happens to Hill, Bill could be president again.

Is that possible?

While this possibility would raise constitutional issues, I believe the answer is Yes. The 22nd Amendment states "no person shalle elected to the ofice of President more than twice."

Thus, he may be elected Vice President, and I believe he may become President again through a means other than election, e.g., succeeding upon the death or resignation of the President.

But Amendment XII states: "But no person constitutionally ineligible to the office of President shall be eligible to that of Vice-President of the United States."

Bill Clinton is Constitutionally ineligible to be elected president, therefore he is ineligible for the Vice Presidency as well. However, He can succeed to the Presidency from the Speaker of the House position (if he became the Speaker of the House).

Are you sure? The ammendment only prevents someone elected president twice from being president again. How does it prevent him from being vice-president? If he became the veep and the President died in office, then the ammendment would prevent him from succeeding, and the SOTH would then take over.

Cleveland won the 1884 election, was defeated by Benjamin Harrison in 1888, but ran again in 1892 and won. He's still the only president to ever serve two non-consecutive terms.

1) The first man you mentioned may barely make it out of the primary stage as the majority of Republicans are still undecided per various polls that I've seen.

2) Alcoholism doesn't have the same stigma as drug use. Plus, "Jesus" saved him from his alcoholism.

3) The three men you refered to were not Negros, and two of them have proper easily pronounceable last names.

It turns out this issue was discussed in the press in 2000, when some suggested Gore should name Pres. Clinton as his VP running-mate.

The 12th Amendment would allow a Clinton vice-presidency. Its language only bars from the vice-presidency those persons who are "ineligible to the office" of President. Clinton is not ineligible to the office of president, however. He is only disqualified (by the 22nd Amendment) from being elected to that office.

This is no mere semantic distinction. Article II of the Constitution carefully defines exactly who is "eligible to the Office of President": anyone who is a natural born citizen, at least 35 years old, and has been a U.S. resident for at least 14 years.

For example, Secretary of State Madeleine Albright is ineligible for the office of president because she is a naturalized, rather than a natural born, citizen. Accordingly, the 12th Amendment renders her ineligible to the office of vice-president as well.

But Bill Clinton can serve as vice president, because the 22nd Amendment's prohibition on running for a third presidential term is not a condition of the office of president.

The 22nd Amendment states: "No person shall be elected to the office of the President more than twice, and no person [who has served more than half a term] shall be elected to the office of the president more than once."

The language is quite clear. It places no limits whatsoever on how many terms someone may serve as president, only how many times he can be elected.<<

1. It's possible, but current trends make it quite likely. And the polls I've seen show Guiliani has greater support than the total numbers of undecideds. He'd still probably wins even if they all eventually decide to vote for someone else, as long as he maintains what support he currently holds right now.

2. Alcoholism carries a greater stigma than admitting you experimented with weed.

3. The country would have elected Colin Powell in a landslide had he decided to run in 1996. A black man can be elected president, but he can't be a Democrat.

Interesting. But this appears to be based on how one law professor interprets the meanings of the words "ineligible" and "disqualified". One could say that someone labelled as the latter is automatically labelled as the former by default.

It's grey and the SCOTUS would have to clear it up.

No person shall be elected to the office of the President more than twice,

(self explanitory)

and no person who has held the office of President, or acted as President, for more than two years of a term to which some other person was elected President shall be elected to the office of the President more than once.

(If Bush could not complete his current term, and Cheney steped in, as there are less thn two years left in Bush's term, Cheney could still seak two full terms. If something had happened to Bush before the mid term elections, Cheney could only seek one solo term)


But this article shall not apply to any person holding the office of President when this article was proposed by the Congress

(didn't affect Truman)

, and shall not prevent any person who may be holding the office of President, or acting as President, during the term within which this article becomes operative from holding the office of President or acting as President during the remainder of such term.
