Whether he was a "pain in the ass" or not, he most certainly did not deserve to die the way he did.

As for "resisting", I do know that is whatever the cops want it to be. But I didn't see Garner actively resisting arrest on the video, which I have, in fact, posted here several times. What I saw was a person having his airway forcibly obstructed, causing him to struggle for breath.

Pantaleo, as established by the time index of the video, begins choking Garner three seconds after grabbing him. Three. Seconds. I'm sure you, too, would be "resisting", if you were trying to get air into your lungs.

I can't stand this talking point, especially for drugs. Because I really believe that everyone has a "special" supply of locally grown organic drugs and they didn't just pay for the cartels to destroy entire countries, cities and families.

I get your point, obviously I would want both to win over Warren, but unfortunately New York City is not a microcosm of the rest of the country! New York City does not have the blue collar vest working and middle-class neighborhoods that it once had. Actually, the ME ruled that Garner died of airway obstruction, caused by manual asphyxiation.

This wasn't just "duly noted", it was the primary cause of death.

The reason why they could not indict the cop is because he did not die of asphyxiation to his throat caused by compression of the Elway which was due to the position not he was prone on the ground and, due to his obesity. You are a grown man, in my age group, if you really believe that myth that police officers go out there and purposely want to kill people of color as they say, you are sadly mistaken. People that killed due to their own actions!

The reason Pantaleo wasn't indicted, is because no Staten Island grand jury is going to charge a white cop for killing a Black man, even when that homicide is shown to them in living color. Garner was choked to death, the ME said so in writing, and that is a FACT.

There most certainly are cops out there who have no problem killing people of color without a second thought, and this is at least partially because they know there's a fairly good chance they'll get away with it. The cop who killed 12-year-old Tamir Rice, for example, took just two seconds to shoot that child to death. Rice was playing with a toy gun, a normal childhood activity. No verbal commands, no warning, just gunshots. Oh, and no indictment. In the Garner case, even the PC said Pantaleo used a forbidden chokehold, yet that officer is a free man today. I find it incredible that you really believe Garner is to blame for being put to death over an offense that may not have even happened, and for which no death penalty should have been meted out.

I will get to Tamir rice first, he wasn't a 12 year old kid playing with a toy gun which is a normal childhood activity. People were walking by and he was a very tall kid for his age and looked years older and was pointing a realistic-looking gun at Pastor buys, thus prompting people to call 911 and saying that there is a guy pointing a gun at people's heads. When the police rolled up to the scene, he reached into his pocket to grab such gun, thus causing his own demise.

Now, on to Fat Albert. The medical examiner did not put in writing that he was asphyxiated via choke on the report. Did you see the official report yourself? He died from his poor health and the fact that he was just too heavy to be laying on the floor in the position that he did, thus causing his Airway to close. All you have to do is look at the video!

Now, on to your last statement. Do you really think that it's like this Saturday Night Live skit with Eddie Murphy pretending he's a white person and that white people talk about Exterminating black people and their whiteness behind everyone else's back? Of course not! That's absurd! To think that a jury actually is going to acquit someone of cold-blooded murder because of their race is out of this world! He did not get invited because he did not commit a crime! And yes, Eric Gardner was known to everybody and so were his problems. You carry so many victim cards on your back, it blocks your whole view of reality!

The medical examiner wrote that "compression of [Garner's] neck and chest" were the primary causes of his death. This was reported by every major media agency in the city, and is a matter of public record.

In the Rice case, there is surveillance video of the shooting. Rice is turned with his back to the arriving cop, and has no time to reach for anything before the cop fills him full of holes.


Oh, and race plays a major role in our criminal justice system, every single day. In a borough like Staten Island, this is especially true. The DA, Donovan, wasn't interested in indicting a white cop for killing a Black person, in a county full of his (white) constituents, many of whom are city cops. He deliberately made it easy for Pantaleo to walk. If you think first responders don't also look at Black people a certain way, note that the TWO EMS crews that responded to the Garner incident both failed miserably to do their jobs. They saw a Black man in police custody, and decided he wasn't worthy of the most minimal medical intervention, even though he had stopped breathing by the time they arrived. That is the reality of the society we live in.

I saw this in action firsthand too many times. I know full well what some cops' attitudes really are.

These cops did not just encounter Garner and start manhandling him. They were speaking to him for at least several minutes, attempting to have Garner surrender peacefully. Garner did not and eventually a forceful arrest had to be effectuated. If Garner had simply submitted to the arrest, he'd be alive today.

The point is that his airway whether it was forced shut or not wasn't constricted long enough to kill him alone. It was the beginning of a chain of events that resulted in his demise.
Everyone has to be willing to admit, no matter what your ultimate opinion on this matter is, that there are several factors that are part of this equation.

If I hit someone unjustly, not hard enough to kill the average person, but the person I hit happens to be ill and dies, I get charged with manslaughter, don't I?

I was on a jury once on a case where the defendant was charged with murder for a robbery where the act of robbery gave the victim a fatal heart attack.

If that's true, why did the ME say manual asphyxiation was the primary cause of Garner's death? Yes, his size and health might have contributed to his death, but only insofar as these factors were aggravated by the fact that he was being choked to death.

The ME cited his poor health as a contributing factor. The ME also cited his prone position as a factor.

So now police are not allowed to force suspects to the ground to effectuate arrest because one of them might suffer as a consequence? Please. This was an unfortunate outcome, but one that was caused by a man in poor health playing a dangerous game with the police.

And I will be willing to bet you that 95% of the cops do not think of black people the way you just described. You make it seem like it's a klan meeting. I'll tell you this much, if they met Eric Gardner in different circumstances, meaning not on a 911 run about him, each and every one of those cops would have taken a bullet for him and would have also perform CPR to try to save his life if anything happened to him

It's based on an old, OLD legal doctrine in criminal law that the defendant "takes their victim as they find him." It's sometimes referred to in tort cases as the "eggshell rule."
