I've had a number of encounters over railfan photography since I started in July of 1958. During that period, I have taken over 90,000 slides and photos. The first encounter was in Boston in 1959 at Mattapan with a MTA employee. "Hey kid, you can't pictures!" Over the next 42 years incidents were few and far-between.Post 9/11, it's a different story: NJT, Metro North, Miami and Pittsburgh. These encounters have been met with direct action -- i.e., letters of complaint, web reporting, urging other complainants to follow suit. As a result, progress has been made. For example, following my run-in with chief of Miami-Dade Metro, Eric Muntan, in May 2009, my letter of complaint and subsequent postings on Subchat and photography blogs, led to a clarification of non-commercial photography, which was posted on a number of websites. At the urging of myself and others, an encounter at Freeman St. between "rtype3995" and NYPD led to the elimination of harassment of non-commercial photographers on the subway system. Since 9/11, others have picked up the ball, such as BMT lines, and hopefully we will continue to be successful in our battle to protect our freedoms. Basically, all I want is to be left alone to pursue my hobby. I'd like to express my thanks and appreciation to those who have supported me in my endeavors. |

I would not be surprised if there are rules forbidding the photography of the MVMs being serviced and other revenue collection processes. And even if there are not, common sense would probably suggest one shouldn't try it. I would be. Because if it's not in the rules we all know and love, then...it's not in the rules! Are you saying you think there are secret rules? Or that there should be? Or that we should try to imagine what secret rules exist and then try to follow them? And I totally disagree that it is common sense not to try it. It is part of the regular routine of subway operations. And many people enjoy photographing routine subway operations. I would not and should not discourage anyone from photographing what is legal to photograph. If it means a police officer properly investing it, that's fine, and I'm all for it. I have nothing against the NYPD properly investigating what some passenger or employee might think is suspicious, except if it is done at such a ridiculous frequency and regularity that it takes away too much time from more important police work. Take Pride,

No, I didn't say you have to believe it. I meant that I responded based only on the available information and the fact that none of Nilet's claims about these types of matters have ever been shown to be wrong AFAIK. So there's no reason to doubt his claims and then post replies based on some other assumed version of events. You can reply based on the available info, and if you're super touchy, then you can add a disclaimer that this reply is based on the assumption that Nilet is telling the truth, but if he's not, then you withdraw your post. |

Yes, in my opinion, but also based on all available evidence. There is absolutely no evidence that anything happened other than the way he described it. Being an employee would not help you imagine a different, correct, set of circumstances since there are an infinite number of possible scenarios that can play out at any time, and only one did, and only a few people know what happened. However being an employee and an active member of this forum means you should be well aware of the rules and that photography is not prohibited in any public areas as long as no other rules are being violated. |
