If someone with a camera is in a publicly (legally) accessible area and sees a damaged subway car and photographs it, it's perfectly legitimate.What if a photographer had taken this picture from an apartment window overlooking an elevated line and posted it? You guys can post all the nonsense you want about what to photograph or not, but this picture is legit, it's leit for posting, for putting in the New York Times, whatever. No one, not you, not supervision, not the Transit Bureau, has any say over it, except if the photographer were blocking access to employees or other riders. |

If an incident/accident happens especially in front of the customers, and someone has a camera or video recorder, there is no rule telling them they can't post those pics. The only way that photo was taken was unauthorized access, an employee taking them and sending them out, or before the area and station was cornered off the pic was taken. |

And even if someone takes photos in an unauthorized area, AFAIK the photos are still theirs to do whatever they want with. All NYCT can do is charge them with being in an unauthorized area (fines, arrest, whatever the case may be). I guess they could also sue to prevent the person from using the photos, but that would be a long shot. |

But if it was taken from an in-service platform where trains were still running (I don't know if that was the case), then you really can't and shouldn't close off the platform. People still need to detrain from all doors. There was no safety concern here that I know of. |

I guess they could also sue to prevent the person from using the photos, but that would be a long shot.I won't speak to that first sentence, but as to the last, it is really, really hard to prevent publication of something (that someone wants to publish) unless it deals with stuff like troop movements or other really, really sensitive national security information because our constitutional law understands prior restraints to be disallowed in all but those kinds of cases. |

That would be bad press to sue for something like that. If the person was in an unauthorized area, then someone who suppose to make sure that did not happen, dropped the ball. The photo is still theirs unless the MTA finds out they are unauthorized, and request PD to take the photos and/or camera, while having them arrested for trespassing. |

If the area in question was cordoned off then I would not try to trespass but if I were able to take such a picture from an open public space then I am free to do with it as I please. Thousands of freelance photojournalists take pictures at accident scenes daily from behind police lines - this is the same thing. IF I worked for them then I would follow the terms of my employment. |

We can care less up here at surface. We don't get the attitudes, except from road personnel (dispatchers or road supers), sometimes. Most are cool, and love it when you do what you suppose to do. They will work with you. If we have a problem dispatcher, or road supervisor on a line.......well we have weapons at our disposal, and either they will one up on us, and we will one up on them by getting cut slips, which means overtime pay. I'll leave it at that. |

I have heard the way they talk on the radio, then you have to "call" that same person after its said and done, knowing you screwed up just waiting to hear that person tell you.. Thats Surface this is RTO Night and Day im sure some people in RTO feel the same way about Surface.. Not me far as im concnernd we are all in the smae boat.
