All NYCT can do is charge them with being in an unauthorized area (fines, arrest, whatever the case may be). I guess they could also sue to prevent the person from using the photos, but that would be a long shot.I won't speak to that first sentence, but as to the last, it is really, really hard to prevent publication of something (that someone wants to publish) unless it deals with stuff like troop movements or other really, really sensitive national security information because our constitutional law understands prior restraints to be disallowed in all but those kinds of cases. |
