Perhaps this is another potential weakness photo ban opponents should attack. It took a lawsuit in the 1950's to give TV reporters the same status as print journalists. Another re-definition may be necessary.

This will certainly happen eventually, but it probably won't happen soon enough.

Note that the proposed rule doesn't directly define the press -- it leaves that definition up to the NYPD. Don't complain to the MTA if you don't like the NYPD's definitions.

I think it's time to revive the motion put forward with this photo ban was first proposed. Because remeber folks, this time it is on the State Register and the official 45-day comment period has begun. After that, if it passes, it is for real!

Everyone should gear up their letter making, contacting the press, even re-doing the protest. All our of efforts should be geared at defeating this thing -- crushing it before it comes to pass!

Thomas and Scalia are strict constructionists. Unfortunately, however, photography didn't exist when the Founding Fathers made the First Amendment. Fortunately, however, one could still argue that photographs constitute speech, and as they aren't obscene, the subway photos would still be federally protected speech. I think.

Been TRYING to tell you guys this since WAY before the election - this move was a done deal this past summer. Try to take photographs anywhere NEAR CSX property (such as a certain streetcar museum where CSX crosses over their tracks) and see what happens. "Photo ban" has been in effect HERE since a couple of weeks after 9/11 and in each case, at tht direction of Department of Homeland Security. That MTA has held off on the "me too" as long as they have is testimony to the bureaucratic inertia at MTA.

I took a lot of guff for the past many months over this, so "told you so" ... and no, MTA is NOT going to reconsider. Like any other "public comment" they'll accept the comments but don't expect any changes.

And for the rabid who insist that this isn't about Bush, then you can tell yourself that it's all Clinton's fault. Bottom line, sell your camera or go to jail. Nobody wanted to listen, here you are ... :(

Interestingly, CSX the same company that is cutting back track maintenance from 12' about rail centers to 6' about rail centers, had a huge presence at a large national shippers' annual conference, and they were one of a handful of companies who were handing out free Pina Coladas.

One guy spoke to me and asked me if I knew what CSX was. He said: "We are a large railroad serving the Eastern Seaboard".

Well I guess once again we will have to write letters. Though the MTA generally gets its way with everything. Look at the outrage over the fare hike yet they are doing it anyway.
I refuse to obey authoritarian laws such as silly photo bans. The Depends Patrol can just wet their pants for all I care, when I travel and visit train stations I will be taking photos. And no one, not even a Commie Pig will stop me.
I refuse to conform to the abolishment of our civil rights.
It's not like photographers haven't been harassed anyway, it's been going on since 9/11 and 3/11. This fear is gonna kill us as a free Nation. I refuse to give in.

Well..It starts with "A NO PICTURE LAW"...Then to producing I.D for every little thing..restrictions in travel..3 hour waits to board a plane or inter city train...major check points at almost every road entering/exiting the city...strict screening for the most meager of jobs..BIG BROTHER watching your every move...random sweeps on subways...Police stations at every river crossing...Police stopping/serching random people on the street without proper cause...but claiming cause when questioned...

Wait a minute..they do this NOW..Don't they?

I mean who could ever imagine that taking a photo of a train would be such a terrible thing to do. But some people chose to use attacks and spread fear over them, so they can control the population.
I sure hope locking the end doors isn't included in the Register. That makes me feel less safe. There was a story about a fire on a funicular (I'm probably not spelling it right) the other night on TV, and because the end doors were locked, people were trapped in a fire. It is important we write the media about this proposed photo ban and get noticed. We need to make people realize this isn't just about photography.
Sure, it may seem like a small thing to must, since most photographers like scenery and other stuff and most ppl don't take photos in the subway. But it's one more step in the erosion of civil liberties. People need to be convinved that trading away civil liberties for a sense of "false" security is the wrong road to go down.
Also with many small cameras available nowadays, a photo ban will do nothing to stop those determined to get their photos.

I would hope that in addition to credentialled press, members in good standing of the NYCT Museum, who can show a body of work should also be able to get a permit, or otherwise be allowed to continue to take pictures.

Another reason for MTA to "go for it" ... "tort reform." If it's unlawful to take pictures of "unsafe conditions" then the MTA might not be sued as easily ... but the main purpose for this is national ...

The proposal is for a change to the rules, not for a change in operating procedures. End doors will not be locked unless they are retrofitted with both remote unlocking devices and windows that can be popped out by passengers in an emergency, and that's not going to happen. (All 75-foot NYC subway cars have both features.)

Ever notice that 7 trains are never made up of two five-car sets and a single? Now you know why: passengers in the single would be trapped unless the cab in the next car is folded up.

Don't get me wrong -- I don't think that moving between cars should be illegal. But it will still be physically possible, and my hunch is that the cops won't bother enforcing it.

I want to publish a book.

I want to publish a book, about 60 pages or so long, full color pictures of subway subjects. Appropriate text and stories to go with it. I'll need about 80 full color photos of subway subjects.

1) you must own the rights to them, and allow them to be published
2) you must have the name of the photographer (yourself)
3) address and etc.
4) time date and place of the photograph
5) interesting information on the subject, camera settings etc.
6) you should be able to write a short article about your photograph, about 20 lines, maybe more
7) a photo of yourself

This is a flegdling publication so there will be no payment for photos or articles, and copies of the book, in full color, may be purchased (on-line) for about $15, maybe more, I'm not sure about the price yet.

I would plan to print similar books perhaps twice each year, as long as I can get the material to print.

All you get out of it is being published as a freelance photographer. Maybe that will help you to get a Press Card from the Police Department.

If I make any money from the sale of the books, I'll put up a web site to promote the books and try to do them on a regular basis. Perhaps an on-line version as well as a print version.

The photographs MUST be of very high quality worthy of full color publication. Good story writing is also essential.

What shall we call our publication? "Transit Lions", "SubChat Journal", we probably need a contest just to name our publication.

Not to me. NYPD press credentials are intended to control access to cordoned-off police and emergency areas. You don't need to cross any "police line" or "fire line" tape to board a subway or bus.

Maximum $100 if it goes to the Transit Adjudication Bureau, where most things wind up.

Guess what Unca Kevin, CSX tried stopping photos being taken from BSM property. It resulted in two CSX cops being arrested by Baltimore City Cops for trespassing and assult.
