Thomas and Scalia are strict constructionists. Unfortunately, however, photography didn't exist when the Founding Fathers made the First Amendment. Fortunately, however, one could still argue that photographs constitute speech, and as they aren't obscene, the subway photos would still be federally protected speech. I think.
