However, what is a bigger problem is when a plainclothes officer stops someone, and the person thinks it is a robbery (but the officer turns out to be real).As for the original case, I would recommend to the original poster to just pay the fine, because the chances of winning are slim. The defense of being unable to stand when the next car is clearly empty can't be used here (of course the officer then may just say that the passenger should have considered applying for paratransit). |
