I'm not sure you quite get how bingbong works, but that's for you two to figure out. I *will* say that the "no controvery" boilerplate in performer contracts goes back to the 1950's and is ALWAYS in those contracts.How it's enforced is up to particular management - it can be a grumpy letter in your personnel folder, it can be a stern lecture from the manager in an office behind a closed door, it can be a suspension, or you can get shitcanned. But have no doubts that "no controversy" is ANCIENT boilerplate in EVERY performance contract. |

I kinda gave up arguing with them over it. Bingbong and I know through running several businesses and managing others how it works. The other folks seem to think that the "law" is written in stone and that's that. But those of us who actually have to deal with it know that the "law" is only a set of rules that are subject to INTERPRETATION and NEGOTIATION to arrive at a solution to any one particular issue.Both of us also are keenly aware of how entertainment industry contracts work, having signed numerous ones over the years. What these folks don't get is that just because there's a specific boilerplate clause in these contracts that specifically stipulates against "adverse publicity" and that you can get your ass kicked out the door in an instant for bringing bad publicity upon your show, station or network, the CHOICE to enforce that rule is up to management. They might not kick your ass out the door the FIRST time that you violate it, but that violation gets held in abeyance instead. Violate it again, and you WILL get kicked out that door. Such codicils in those contracts serve the purpose SOLELY of protecting the "show" and not the performer. Some performers will bring in enough cash that it might not benefit the network to enforce it right now. But when they get tired of the shit, you're out the door, that clause ensures that you have no recourse to the network if they opt to enforce it. And that's what it's all about. |

I WISH I could post some of my TV/radio contracts here, so some people could really get an idea of what Robertson had to agree to. A standard SAG/AFTRA television contract is getting pretty thick these days. (Mind you, I am just a screenwriter on almost ALL of my current TV projects.) I think some posters here, who really have convinced themselves they know entertainment contracts, would be absolutely FLOORED if they actually saw what the networks get out of you for those coins they begrudgingly pay you. Remember that five-minute short film I posted here? The contract I signed for THAT was thirty-two pages long. Sheesh!The short, simple version of a modern TV contract is "we owns your arse."
