It's OK to make a distinction between a person who planned a murder and someone who killed in a fit of rage.A prosecutor has to prove the intent behind the premeditation. It's not like it's because "he says so". Same with hate crimes. If he/she can't prove that the intent behind the assault or vandalism was motivated by the premeditated intent to terrorize the targeted group, there will be no sentence added. |
