It shouldn't matter that he killed the victim because he didn't like white people (for example) or if he wanted to rob him.So somebody that assaults a person in a heated argument should get the same sentence as somebody who assaults somebody because he hates white people? Criminal statutes are awash with aggravating or mitigating cirumstances that lead to additional or less penalties. Those circumstances are often "the WHY he did it?" This is nothing new. |
