While I may RELUCTANTLY move on, I report all incidents to the NYCLU, NPPA, CCRB (if applicable), senior management, and all the photo rights blogs on the net. This issue is finally getting national attention thanks to photographers who speak up , in spite of those who remain silent. Do you think we would be getting press attention if it were not for photographers who stand up for their rights? And harm WAS done - your time was wasted - you missed shots, etc. It's not worth the hassle, seriously. Perhaps - perhaps not. Some photographers have won five figure settlements. I could use some new lenses at taxpayer expense! Our goal is to end the harassment once and for all so we don't have to continue dealing with it and apologizing for doing nothing wrong. |

If that officer was a "rent-a-cop" then he would have needed to call the police. If he was an MTA property protection officer, then he likely has peace officer status and could have made an arrest. Since he was *supposed* to be guarding a machine and a revenue agent he obviously had other things that he should have been doing, and should not be arguing with the geese, which is prohibited by NYCT rules in any event.If he wants to engage you, you have the right to ask for his ID and badge, and he does not have the right to not show these to you. *I* have been "visited" by law enforcement officers and have always been treated correctly, and never denied the ability to take pictures. As a matter of fact, I drag out the brochure about my railroad, and if they do not break of the inquisition, then I will break out my timetable and string maps, and show those to them. And THAT document is more than 30 feet long. They would rather say thank you and have a nice day than to look at that thing. I respect Nilet, and his photography. He and I have different political views to say the least, and neither of us will let the other get away with over the top political opinions. But that is ok, because anybody who has a railroad map that looks like a cockroach eating Long Island cannot be all that bad. Still, I have to agree that first appearance and attitude can be a point of escalation. Probly has to do with profiling of some sort, and there is nothing that he can do about that. Maybe he should take his picture around to all of the precincts with a notice that he is a good guy and does not need to be bothered so much. (NOT) |
