If he was not fingerprinted then his was not arrested. He was detained and transported to a suitable locations were summonses in lieu of arrest could be issued. If a DAT (Desk Appearance ticket) was issued, then he was arrested for a finger printable offense, and most likely he was fingerprinted before he left the Police facility.Michael |

A number of railbuffs have difficulty with interpersonal communication and social cues. These difficulties do not often show up on discussion boards. But in person it can be a problem.I am not saying the cops were right in this case. They were not. However, I would want the cops to know more about how to deal with people who are auutistic, have Aspergers or other social difficulties. If the cops understand that in some cases, railbuffs are "mouthing off" because they don't have the skills to be diplomatic (they have a disability), the cops can handle things a little differently. Making an arrest involves paperwork, trasportation, creating a court date, etc. I want the cops spending their time on real perps, not railbuffs snapping pictures. |

Well, my brother IS informed of the memorandum that was out about photography being LEGAL in the MTA system, providing it is not being done in restricted areas.It should be noted that the MTA Police have no call in the security of the NYCT system, NYPD Transit Division does, and sadly it is not well explained to them about the legality of photography in the system, they just do as their superiors inform them, and a lot of them, and I do mean A LOT, are still in the 9/11 mode of hassling anyone snapping pics in the system, why I wish I could truly explain, but it mainly boils down to inability of the superiors of getting information out to them about photography and its legality. |

Actually, it's been your experience every day since you were born. You're just not paying attention.Every time a suburban soccer mom gets on the expressway with her SUV in Nassau County, a poor schlub who is subway dependent subsidizes her use of the road. Every time I take an itemizable tax deduction, some poor schlub who can't use any of those deductions pays extra tax for me. When I pay a flat sales tax to fund road-building, as occurs in the midwest (example: Jackson County, MO - Kansas City area), the poor are hit harder than the rich. When taxes are cut across the board, as opposed to graduated based on income, the rich can put a much higher proportion away in savings. The poor cannot, and hence end up doing more spending proprtionally and paying more tax. |

Most likely here's what'll happen to him in court.If you're lucky, chances are your case will be taken to the Manhattan Criminal Court (btw if you're lucky on that day you might find a few popular music stars there too.) The day I went for my so called "discon", I ran into someone affiliated with "the game". So hey, take it as a nice little vaca sort of speak out of the trouble lol. Anyways back to point. Most likely, if the judge is lenient, your case will be lowered to just "discon". Stay clean for a year because this is only a misdemeanor. Get a lawyer obviously to fight the case. Tell the lawyer everything. From there you'll be fine. No problems with records, everything goes clean after 1 year of the court date. Take my advice, not worth fighting back with cops. You have the nice ones and you have the ones that are just out of the academy (rookies) who think they're showoffs. Had my run in with some of them from the 75th. Next time when a cop stops you, as some people mentioned here, keep quiet, let them talk what they have to say. Keep calm and just get a lawyer and fight back. And yes, I also believe this was unjust. A few years ago, I got pulled over for having a Bike on a sidewalk. I was 2 blocks away from my house. This was a rookie who pulled me over and gave a summons for a bike on the sidewalk. Claim made? "You can commit crimes on a bike" Spoke to one of the cops I knew about it and he even agreed it was wrong (can't say the real statement but pretty much she was a b..." lol). So yep.. Good luck with your case buddy and hey let us know which famous people you'll find when you go to Manhattan Criminal Court :D |

When I pay a flat sales tax to fund road-building, as occurs in the midwest (example: Jackson County, MO - Kansas City area), the poor are hit harder than the rich.How can they pay more? They are not spending more. The rich *always* pay more sales tax than the poor because the rich spend more money. (Which btw, is earned by the poor.) Ekonomy 101 was not your strong suit, I take it.
