He was not arrested, only detained. He received a summons for "illegal" picture taking (in the eyes of NYPD), which he would have received even if he was not detained. Therefore this is not a criminal matter. By detaining him the cops are trying to discourage him from taking pictures in the future. He has a right to take the matter to court and fight the summons by submitting the TA rule allowing photography to the judge. The other 2 summons' are subjective ones and the judge would have to decide based on the testimony of all parties involved. Of course 3 vs. 1 the cops will always stand up for each other. It comes down to this guy getting a lawyer, which would cost more than the 3 summons' unless ACLU volunteers to defend him if it goes that far. Even if he wins, it will not set new NYPD policy. It's sad that a man who is doing a legal activity has to get harassed like this, but his big mouth is what escalated the matter. |
