It was on the mezzanine level just up the stairs from the platform and (IIRC) before the turnstiles. Also, it was more than two seconds; it was a couple minutes at least. |

If that is the case, I would sue the officer personally ALONG with the department (using the officer's badge # and forcing the NYPD to identify him/her in court papers.) |

However, if you ask for a trial by jury, handcuffing without reading rights at any point is grounds enough---making the picture deletion irrelevant. In addition, one could say that no warning was provided...and make sure the questions are crafted into making the officer say something contradictory---OR make it look as though the officer was COACHED on how to answer questions. |

The key, of course, is to claim it RIGHT AWAY, and take the chance that the officer refuses to call for EMS right away. (As I said prior, however, for myself, it would not be hard at all, and I probably wouldn't be faking it.)In addition, handcuffing without fingerprinting is also a violation (NYC policy requires it to be done, even if it is destroyed later), and is evidence I would use against the officer. BTW, it has happened when a person was wrongfully arrested and died because of it---the NYPD ended up paying a $5M+ settlement for wrongful death. |

I called the NYCLU, and they said to write a letter to their legal department. Unfortunately, they want the case number and name of the investigator from the CCRB, which I don't have yet. I filed the complaint online last night, and apparently, they make a point of calling within 24 hours of receiving the complaint, so I'll probably get that information today. |

I've been handcuffed, being handcuffed is not being arrested."For your saftey as well as ours we will handcuff you as my partner goes to the booth to check your metrocard" is exactly what the PO told me as he put on the braclets. They accused me of using a student metrocard when in fact I entered right after a student and the cop thought the light was for my swipe not the kid ahead. |

I know it's petty, but it is petty stuff like this that one should force the courts to get involved in. It might set up a legal showdown. Also, inform the cop that if something illegal was done, issue a ticket so that it can be fought in court. Otherwise, a formal complaint followed by legal action would be done. (This is in addition to claiming---at the immediate time---deliberate attempt to injure by the officer.) |

What was also nice was that they decided to run promos for the entire weekend before using a 3 second clip of me which they ran once an hour for the proceeding 48 hours. My friend's wife saw one at 2 AM but it was over before she could wake up her husband. Too bad I didn't get a copy of the promo because I couldn't get my VCR to work. The mailman recognized me just from the promos! The piece was 0:2:24 long so with the promos I figure I've got another 10 minutes and 12 seconds of fame left. The video was also available on the internet for two weeks, and the text for several months. Also, the producer called me at 5 PM to tell me I would be on at 5:15. Due to an unscheduled breaking story it actually ran at 5:23. So it's not only the trains that run late. |
