You may also get some assistance from Scott Morgan at Flex Your Rights - www.flexyourrights.org I am particularly concerned that you were handcuffed. This is a legitimate procedure if the officer feels you are likely to be a threat to their safety. I very strongly feel that that was not the case - and if so, this would be false arrest. You should have asked, "Am I under arrest," or "Am I free to go" as you were being cuffed. If not, you may have a case for false arrest, which is a serious offence for the officers to commit (probably more serious than the destruction of property). It's definitely worth looking into if you're going to pursue the legal route. I'm relieved that you got their badge numbers. Just make sure you know what department they're with. Most likely NYPD, although it's also possible it was MTA PD. Also file a complaint with the Civilian Complaint Review Board. Make sure you get from them an OCD number, because this is how they keep track of complaints. If you call 311 they'll give you a case number but it's useless. Make sure you follow up with the CCRB directly. Also file a complaint with the NYPD Internal Affairs Bureau. This should be done in addition to the CCRB complaint. You may consider CC'ing your complaint to the Mayor's Office, the Police Commissioner's office, and the Chief of Department's office. I would definitely make a case out of this. |

Try sending an e-mail to Channel 7 (The Investigators or 7 on Your Side.)I did that last summer with a problem I was having. They called me two days later and four days after that I was on TV with the problem resolved. They were very nice and after they solved the problem for me by getting my money back, they asked me if I still wanted to go on TV or not. In spite of all the bad things we hear about the media, they were very nice and it seemed like they really cared. I think they investigate very few of the complaints they get, but if it interests them, you're in luck. You could try the other TV stations too. You've got nothing to lose. I was impressed with how quick they got results. |

I have now submitted a complaint to the CCRB using their online complaint form. Witnesses would help, but I didn't get the contact info for anyone in the area. I sort of recall that there were a couple TA employees nearby (to help confused people who had just been kicked off the terminating (A) trains find the shuttle beese and get where they need to go) and I was wondering if it would be possible to get the names of people assigned to that location at that time so that I could call upon them as witnesses. I still haven't contacted a lawyer or recovered the pictures, but I plan to do both. Further updates will be posted as events unfold. |

Actually best not to touch or recover the pics from the memory stick or camera. Bring it to a computer guy and let him write up a report that it was in fact deleted, but don't even let him recover the data. It's the only evidence you have, in that the camera is un-damaged. You're going to have to prove a negative here, that the camera not having any pics is proof that the cops deleted them. |

The worst case scenario is that the letter ends up in a circular file someplace and nobody does anything about it. The best case scenario is that somebody in the mayor's office (not necessarily Bloomy, but somebody in his office) reads the letter, finds it compelling and starts placing phone calls, and the people called will place further phone calls to find out what the deal is, and the calls start reaching many of the same offices that received the original complaint letters you sent. Now, those offices that received the complaints (and may be inclined to do nothing about it, considering that they receive many, and most have little basis in fact and even less in the law) are receiving phone calls from the mayor's office, from the Chief of Department, from the Commissioner's office asking what this letter is about, and that gives them a little more of an incentive to do something about it. The way to be sure the letter winds up in the "best case" above is to make sure it is compelling. Not by making up stories or making accusations of vast conspiracies (which all end up in the circular file), but by being truthful and straightforward, including many details, and of course having the letter properly structured, respectfully addressed and (though this should go without saying) grammatically and orthographically correct. These are the things that staffers will note in a letter received (among the many they receive every week), and will end up on the top of the pile on their desk. They're the ones they might just make a phone call about. |

However, they did take the camera; even if they didn't delete the pics, that's still a search and seizure and when I asked for probable cause they just said: "We suspect you're doing something illegal" or words to that effect. (They also said: "We're conducting an investigation" with no further details.) Since they detained me on the scene, they require some standard of proof that I'm doing something wrong; I believe it's "reasonable suspicion" to detain me on the scene and "probable cause" for an actual arrest-and-take-to-station. Perhaps the handcuffs were excessive use of force? I plan on calling the NYCLU tomorrow, and shall be asking for legal advice from them. The flexyourrights.org website mainly just describes your legal rights, which I know (more or less). They don't offer legal assistance. |
