If she gives this information fine, it is no skin off her nose. If she does not give this information, just say "Fine, I'll find out who it is and call him myself." Ask for her badge number if it is not displayed. If she refuses that then say "Fine, I'll report that too." And then say, "Since you have no badge, you have no right or authority to make requests of me, and I will continue taking pictures." Am I wrong?Probably, although I do not know for sure. Magnetic media, yes that is exactly right. Optical Media, such as the the CD-R disks that I can use in my camera, those cannot be changed or erased at all. CD-RW disks that I can also used can be reformatted, but that *does* erase everything and there is no way to recover it (AFIK). But that takes time. As for electronic media such as Nilet used, LION does not know how it works. I think that a "Reformat" command would simply return all registers to zero. No hope of any recovery in that. LION suspects a delete command would do that for individual images. But who knows. Maybe all it does is delete the directory, in which case the data would still be available. LION suspects that different systems might do it differently. LION also thinks that he *will* use CD-R rather than CD-RW disks when visiting the Big Apple. ROAR |

That is what I would have done...you will have to arrest me, or I will contact the ACLU and have you named in a lawsuit. (Of course, after the handcuffs are on, I would claim heart trouble afterwards and force the police to remain there while EMS is contacted---and if they don't contact EMS, well, that is another charge to be leveled in a lawsuit, to be accompanied by a formal complaint against the officer.) |

Since you got the numbers, go to the NYPD TB 33 and ask to speak to the supervising officer, and inform him that you are filing a formal complaint against the officers...preferably in their presence. Since the officers placed handcuffs on you without reading your rights, inform them that this is the grounds for your complaint, refusing to read your rights...and inform the supervisor that you are also filing a complaint with the CCRB. However, for a lawsuit, I don't think there is enough grounds for a lawyer to want to take on the case (except for the ACLU, which will take it on pro bono). Also inform the supervisor that the officers refused to provide the information related to the supervisor as required by judicial decision. In addition, state that you were complying and that you were arrested anyway. |
