No cop has the right to handcuff you, Saying we suspect your going to do something illeagal. Take your property and then let you go then give your property back.Your right they did something! Very un-professional of the cops.

This is a typical ACLU type case. You will win, get an apology and perhaps some money. As part of any settlement insist that they post 1050.9(c) in all stations and that officers be mandated to take a class about this regulation.

Yeah, they handed the camera back to me blank.

I re-recorded their badge numbers and I also took one photo of an (A) when I got to Jay Street. Other than that, the card is still blank, awaiting a probe from data recovery software to bring the pix back. I'll post 'em when I get 'em.

Sorry to hear about "Nilet's" troubles. If this is true as reported, the best course of action is to file a police report, make a complaint to the NYPD Civilian Complaint Review Board (CCRB), and also contact an attorney, as there may be civil damages.

Remember, there is a record of this, as police officers are required to write in their Memo Books the details of any police action taken, whenever they receive a complaint. This record stays on file.

Well - go on then. I am of the view that (in the UK at least) there are a small number of police who f**k things up for the rest of them. To say 'most' is wrong; also, if your general perconceived attitude concerning them is along the lines of 'dumb pigs', then that's not exactly conducive to useful interractions - is it?

I didn't respond earlier, but I had a quite different experience yesterday taking pictures throughout the A division. The key, however, is this: Stay in a spot for only about 2 trains each way, then move on. The key is to keep moving.

As for what happened to you, I would seek to take this directly to his supervisor, while at the same time, filing a complaint with the CCRB for lack of professionalism (which in itself, can mean days on the street).

Keep in mind that usually, if you get a warning, it is time to just close up shop and move on. (I have gotten similar treatment from private employees providing service under contract to the government, but acting as though they ARE the government---their uniform would say they are, but I would respond that they are NOT government employees.)

BTW, for my part, I don't take much underground pictures, and if I do, I will do one and take the next train most of the time. But if they warned you, it is time to get out of there and avoid causing trouble.

If you want to file a formal complaint, do so with the CCRB and the supervisor at TB33 (Bway Jct.)...and contact the ACLU for consideration of legal action against the NYPD (because they hired the rogue officers). (Someone here has posted the contact info here prior.)

While I can't really take a stance on this (those who know me closely know why), I can say that a few bad apples ruin it for the rest. Unfortunately, with the standards as they are, the NYPD is that desperate for bodies.

However, with a close friend being an NYPD officer (housing bureau though), I cannot be unbiased. But what I can say is that at the first warning, I would have left and gone to a different location (say, Liberty Avenue), and not put myself in this position.

Um, there was no first warning. There was simply an incident. It was all one incident. Did you even read it??? He said he was on his way out when they came back AFTER him and handcuffed him!

And don't give us this "I have a cop friend" business. Because you have a friend means that there's a possibility that Nilet's story is incorrect and the cops acted 100% in the right??? Come on, Adam.

I was thinking it was around 5:15 or so as that was the time I was right in the area of the Utica Ave Subway Station. I did see a police car parked right by 1 of the stairs to the station. I was only there for about 15 minutes as I left on a Articulated Bus doing the A Express Shuttle

From what I read, there was a warning from the transit employee...at which point I would have left the station completely and go to the street level.

However, after being handcuffed, I would have claimed injury IMMEDIATELY (i.e., heart problems), and claim that it was caused by the officers' maltreatment, or even physical injury, and then press charges against the officers for deliberate injury. (NOTE: For me, this wouldn't be too much of a stretch, however, the former anyway---and I would have said I would demand a ticket---one I would fight, and then take my chance and challenge it in court, since the officer MUST show---and testify under oath---or else it gets thrown out---and my testimony would claim that I was leaving and that I was thrown down by the officer maliciously, causing injury---which would be documented by my having claimed it earlier and by hospital documents.)

In short, I could easily make life hard for the officer in the long run (not immediately, but later on) by claiming deliberate injury, i.e., start claiming that I am ill while under handcuffs and making sure that it LOOKS causally related. Keep in mind that this cannot be escaped by just resigning, as the NYPD doesn't allow officers under investigation to resign or retire. In short, claim deliberate injury and mistreatment, and if they ignore it, then file a notice of claim (I would have memorized the badge number too) against the city and the particular officer.

I'd love to know if you can recover things on a memory card.
However, does sound like abuse of power. You were detained outside the station.
And you did get, what, 6 witnesses who were staffers telling you somethings illegal, thereby they were conversing with you. So even though those putz's will probably say they never saw you before, it's still not like you were randomly picked up without ever talking or seeing anyone.
Too bad you weren't arrested though. then there would've been a paper trail and everything else accordingly.

On the other hand, I bet you may have had a real attitude problem going on there too. Wonder if the badge numbers set them off.

If there are documents saying I got injured (i.e., increased blood pressure), it wouldn't be. (For me, it wouldn't be a stretch at all, as I end up sweating profusely under such pressure.)

It wouldn't be perjury, however...it could easily happen to someone like me who is injury-prone.

From what I read, there was a warning from the transit employee...at which point I would have left the station completely and go to the street level.

WHOA now. You'd leave the station because a transit employee lies to you? Talk about rolling over and letting them win. Transit employees are not even supposed to approach you about photography. If they consider it suspicious, they are supposed to call the police or contact their supervisor. Why kind of society would we have if we allowed people with no authority over us to dictate our actions?

Jeff has stated in the past that as an officer, he would not hesitate to physically damage the camera of someone who photographs him in public against his wishes.

As crazy as it sounds, this is his attitude, apparently. That, or he's all talk.

The web site PC Inspector has free software to download that will recover any files "deleted" from a disk. A related program on the same site, Smart Recovery, does it to picture format files only, but that is just a more convenient version of the main program for people who have difficulty understanding PCs.
