Military Captures do not come under US law.

If you are captured on a battlefield and are a uniformed member of a combatant force then you are a POW, and are detained as such. No civil rules apply. When the war is over your status will be part of the treaty.

If you are a non-uniformed combatant then you are NOT a POW, but are classified as a spy, insurgent, terrorist, or whatever. International rules of combat permit such persons to be shot at the convenience of the captors.

That we have NOT done so is a hallmark of our humanity.
Apparently these too will be released at the conclusion of the military situation.

I suspect in the future the military will simply capture fewer people, and continue the fight until their situation is moot.
