There needs to be some flexibility or a grey area for this all to work. If the buffer were posted with official signage it would become the de facto speed limit and then passing speed would become that much faster.

No you're wrong. How do you even have a drivers license starting a thread like this and answering as you have? The posted speed is the limit which means the maximum speed that you can legally travel. You can go slower than the maximum as long as you stay above the minimum.

To be clear, it also depends on what the legal limit is. While I don't see cops pulling people over to any real extent for going 64 in a 55, as the speed limit gets higher, the buffer probably gets lower. Going 85 in a 75 is a lot different than going 65 in a 55.

I'll bet you all the money that you have. I think that what you meant is that you have to stay lower than 55 mph. Correct?

If a sign lists a 55 mph speed limit then you can legally drive 54 mph. Or 53 mph. Or 52 mph and so on. Maybe you mistyped your initial response and/or misread the person that you disagreed with. He didn't say that you can go over 55 mph. He said that you can drive at speeds other than 55 (lower than 55) as long as you stay above the minimum speed.

Could be it simply coincides with the posted limit. A CT state trooper wrote an article years ago that stated people drive at their best at a speed they're comfortable with, be it 55 or 80. It was in response to arguments that raising the limit to 65 would cause a lot more accidents.

There is a maximum and minimum speed on the expressways and parkways too. It's legal to drive 47 in a 55 mph speed limit zone.
You keep insisting you "must drive 55", that is FALSE. You can't drive over legally, but you CAN drive under the 55, so long as it's higher than the minimum set at 40.

Not going too slow to be unsafe. Stopping distance greatly increased over faster drivers. Usually in a traffic lane with other safe drivers that aren't tailgating.

You owe a lot of people breakfast....

http://www.nydmv.state.ny.us/dmanual/chapter08-manual.htm

SPEED

You must obey the posted speed limit, or, if no limit is posted, drive no faster than 55 mph (88 km/h). Often, it is just common sense to keep your actual speed limit well below the posted limit. For example, the legal limit on an icy or foggy expressway might be 55 mph (88 km/h), or even 65 mph (100 km/h) on some highways, but the safe speed to drive would be much lower. Even if you were to drive at 50 mph (80 km/h) on that hazardous highway, a police officer could ticket you for driving at a speed "not reasonable and prudent" for existing conditions. As with right-of-way, speed limits are not absolutes. You must adjust your speed if conditions require it.

To keep traffic flowing smoothly, some highways also have minimum speed limits. Driving slower than the minimum speed can interrupt the traffic flow and create a dangerous situation. Even if there is no minimum speed limit, those driving much slower than the posted limit can be as dangerous as driving too fast.

http://en.wikipedia.org/wiki/Speed_limits_in_the_United_States

Minimum Speed Limits

In addition to the legally defined maximum speed, minimum speed limits may be applicable. Occasionally there are default minimum speed limits for certain types of roads, generally freeways.

Comparable to the common basic speed rule, most jurisdictions also have laws prohibiting speeds so low they are dangerous or impede the normal and reasonable flow of traffic.

Dudley Police Department

The minimum speed of vehicles traveling on local roads has been brought to my attention recently by a few residents. They have noticed cars traveling at speeds of 10-15 miles per hour on West Main Street and were questioning if this was legal. The main concern was; is there a minimum speed requirement for vehicles traveling on the road?

Speed limits are generally restricted to a maximum allowable speed. Certain factors, such as construction or weather, may cause this maximum limit to be lowered. However; even in these cases, only a maximum speed is focused upon for a violation.

There are only certain areas where a minimum speed can be considered a violation. Some limited access highways, such as the Mass Turnpike, can post the road with maximum as well as minimum speeds, such as 65 and 45mph respectively. These are some of the rare cases which they apply, since the roads are usually reserved for travel at higher speeds and there are only certain points of entry or exit. Slower traffic is expected to utilize alternate routes.

In most cases involving minimum speeds, there are very few occasions when this can be a violation. If the slower vehicle is not creating a hazardous situation and is obeying the other rules of the road, violations are very limited. People who wish to drive well below posted speeds should be aware of others on the road and allow other vehicles to pass safely. This will limit long lines and traffic problems as well as ease the anxieties some people may experience while following slower drivers.

Once again, the Dudley Police Department, along with many other state and local agencies throughout the Commonwealth, will be participating in the “Click It or Ticket” and “You Drink, You Drive, You Lose” campaign sponsored through a grant from the Governors Highway Safety Bureau. There will be designated patrols on the roadways during the Labor Day season focusing on erratic or aggressive operators. Please be aware of these additional officers out on patrol and remember to buckle up and drive defensively.

Thanks again for your questions and comments. Please send them to me at the Dudley Police Department 71 West Main St., Dudley, Ma. 01571 or email at swojna at dudleypolice.com.
