Surveillance video shows an NYPD officer allegedly getting attacked from behind in the Bronx by a man who has been violent toward police before — but he was freed without bail just a day later.

My understanding is that freeing him without bail is contrary to NY law.

New York law doesn’t allow bail when there is 3rd degree assault and assaults are third degree if there are no injuries. Perhaps the word “injury” is subject to interpretation and the cop looked fine to the DA?

"Injury" in NYC is usually based on an ACR completed by an EMS crew, because ACRs are legal documents in New York State. Of course, visible injuries that can be otherwise documented, such as being photographed, also qualify, even if the victim refuses medical aid at the scene, or visits a doctor later.

Thank you. My point to Al was that you can have someone violently attack another person and if there is no injury, such a violent person may be required to be released without bail.

Here's my take on this. Politicians in Liberal strongholds are scared to death to be seen as pro-law enforcement in any way, shape, or form, so they allow these laws to be passed. The judges literally cannot even impose their own decisions on this, lest they "side" with rich or white defendants, while denying others bail ( see the Rittenhouse trial judge for reference). So, with that, the police have to be vigilant as to make sure that these animals don't approach them and get the drop on them. That being said, both of these aforementioned perps would have been turned to puddles had they tried that shit with us.

And yet the two leading vote-getters in the NYC primary for mayor were seen as being the most pro-law enforcement.

What about attempted murder? Bail is allowed for that. And attempting to throw a police officer (or any person) off a subway platform onto the tracks could certainly be construed as attempted murder. But then again he wasn't charged with that so the ADA who didn't charge him was the asshole, not the judge.

I don't blame the judge. I don't blame anyone, but if there is any blame to be directed, it should be directed at NY voters. None of this is possible without them.

I blame the prosecutors, the ADA. It would have been very easy to charge him with attempted murder, however the DA's office has an agenda to get rid of cases as soon as possible. Attempted murder would need a grand jury but it's so easy to say assault 3 degree and get rid of it.

I think NY legislators totally misestimated the sentiments of NY voters on the bail issue.* And then they probably worded the law more leniently than they intended to.

And I think that NY voters totally misunderstood the position of the people that they elected. This is proudly displayed on Cyrus Vance's webpage:

Since 2010, we have reduced unnecessary incarceration and ended the criminal prosecution of thousands of low-level, nonviolent offenses annually, slashing the number of people entering the criminal justice system in Manhattan nearly in half. Some of our signature reforms include:

Ending requests for bail in most misdemeanor cases
Ending the prosecution of marijuana smoking and possession cases, and dismissing more than 3,000 marijuana cases
Proactively sealing marijuana possession convictions for hundreds of New Yorkers through an innovative class action petition brought jointly with public defenders and advocates
Ending the criminal prosecution of crimes of poverty including turnstile-jumping, unlicensed vending, and nonpayment of fines, except where there is a demonstrated public safety reason to do so
Ending the prosecution of unlawful assembly and disorderly conduct
Ending the prosecution of prostitution and unlicensed massage and ‘Loitering for Prostitution’ cases, and
Dismissing 914 Prostitution and Unlicensed Massage cases and more than 5,000 Loitering for the Purpose of Prostitution cases.
Dismissing more than 240,000 old summons warrants originally issued for minor, nonviolent offenses, which subjected New Yorkers to unnecessary arrest, housing, and immigration consequences
Ending the prosecution of most low-level, nonviolent violations and infractions through programs like our Manhattan Summons Initiative
Creating and funding pre-arraignment diversion programs to enable thousands of first-time arrestees charged with non-violent misdemeanors to avoid prosecution and an arrest record, while being held accountable in a community setting
Launching the Manhattan Hope Program, allowing individuals arrested for low-level drug offenses to complete a treatment program instead of entering criminal court, and
Supporting the closure of Rikers Island and laying the groundwork for it by contributing $14 million (of $17 million total) in funding for the citywide Supervised Release program

The Bronx DAs do have a recent history of being pretty left-wing. Voters in Bronx primaries are far from representative of NY voters in general.

Those are exactly the crimes New Yorkers wanted the legislature to be lenient on. No one is hurt if someone smokes a joint (before it was fully legal) or gets a happy ending for their massage.

This is the pertinent bit as "non-violent" is open to interpretation. I don't know all the legal definitions but I've posted examples of 3rd degree assault that most reasonable people would consider to be violent. Just based on what I've read over the last 24 hours, it appears that DA's have a lot of latitude in how to interpret that and can very much influence how cases are charged and prosecuted. In LA we don't even have a law like NY, but our DA was elected by making those same promises.

Yeah and the drug laws, which most approve of, is ultimately what is causing so many issues in places like LA. Drugs for personal use are (mostly?) no longer a criminal offense so people sit around all day injecting heroin while living in tents. Our local politicians see that and decided that what is needed is to buy all of them new houses, because they believe that housing is a right regardless of any other conditions. So we're spending billions to build permanent housing because our progressive politicians don't support shelters given that housing is a human right. Of course it's the government building them so they're ridiculously expensive and billions doesn't go very far.

Unfortunately the vast majority of them do not vote
Decent people don’t want to walk down the street to the smells of skunked out marijuana or sit in their living rooms and experience the aroma.

Then by default they want others to decide. It's their decision.

The smell of marijuana is everywhere around where I live. Especially outside but even inside I can't even leave my balcony door open without the smell filling up my apartment sooner or later. And I live in a 100% non-smoking building.

I live in LA and voted against bail reform and we won, but the courts overturned the law based on a very valid case of unreasonable bail.

In the end, I do want bail reform, just not like what we have. I think that the median bail amount in California was the highest in the country.

Marijuana is as offensive to me as tobacco. I find the smell objectionable but I don’t want the state to protect me from it. The majority of people poll in favor of marijuana legalization.

I do think they should decriminalize all drugs. But I also think we need to bring back institutionalization. IOW one should be committed for using heroin.

I find it more objectionable than weed smoke but I think that might be because I just have smelled it more often. Weed is pretty foul smelling.

You’re confusing North Brother Island with other institutions, like Creedmoor, or Willowbrook. NBI was for infectious diseases.

Now the fact that those institutions were horrible doesn’t mean that involuntary commitment isn’t useful. The pendulum swung too far in the opposite direction.
