The three-fifths definition was detrimental to the Southern states, who wanted all the slaves to be counted and thereby get more seats in Congress.What I'm saying is, absent any real action to stop it in the courts, the Southern states could have reused the three-fifths definition to justify Jim Crow, as those affected by its statutes wouldn't be "full people" under the law. |

There was no action to stop it in the Courts as the provision was amended out of the Constitution using the standard amendment process.The 3/5th compromise did nothing to make slaves any less of a person. They were already lesser persons by virtue of being slaves, which was banned by amendment. In fact, the few free blacks in Southern states (and in Northern states, for that matter) always counted as full persons before the Civil War. |
