There was no action to stop it in the Courts as the provision was amended out of the Constitution using the standard amendment process.The 3/5th compromise did nothing to make slaves any less of a person. They were already lesser persons by virtue of being slaves, which was banned by amendment. In fact, the few free blacks in Southern states (and in Northern states, for that matter) always counted as full persons before the Civil War. |
