Biden had not previously been nominated for president, so it’s not the same. The equivalent would be to say that Warren Burger, Harry Blackmun, William Rehnquist and Lewis Powell were appointed by a president who lost the popular vote, as Nixon ostensibly did in 1960.The difference is that Nixon had to eventually win the popular vote to ascend to the presidency, Bush didn’t. It’s a legitimate, but weak, argument to say that Bush wouldn’t have been the president in 2005 but for his “tainted” victory in 2000. |
