No, I find nothing objectionable about a person dressing up as an MTA employee for a personal, private photo. It does not meet the legal definition of "impersonating". You know, the kind of "impersonating" that can get you charged with a crime. That's the only kind of impersonating that matters.

I didn't ask you for your preferred interpretation of the penal code. I asked whether you find the conduct objectionable.

Imagine that you are an MTA employee. You observe, right before you the actual scene depicted in the picture. What would you do, upon being informed by the subject that he is "a person dressing up as an MTA employee for a personal, private photo. It does not meet the legal definition of 'impersonating'. You know, the kind of 'impersonating' that can get you charged with a crime. That's the only kind of impersonating that matters." ???
