That's exactly why I qualified my statement, but I'm not sure whether it could be applied in the case described because of some complex First Amendment work-related speech issues. But if one interprets the comments as "failing to get along with others", then it becomes a more unobjectionable basis for the authority to exercise its discretion not to select the candidate from the civil service list. Anyway, my qualification is meant to note that it is at least arguable as respects a civil service title in a way that it's not on the non-competitive side. |
