Deletion of photos is destruction of property.If this officer came up to someone and (for the sake of argument), took something out of their purse and intentionally broke it, would that officer be "doing their job?" No, on the contrary, unless they have a valid reason to seize the property (i.e. it is contraband or being used in the commission of a crime) they are acting in a manner utterly incompatible with their job description. The law says that subway photos are NOT contraband. The law says that subway photos are NOT illegal. Nilet was NOT committing a crime when he took those photos. Therefore the officer had absolutely zero justification in seizing and/or destroying Nilet's property. Yet the officer did so anyway, and quite blatantly and intentionally at that. I really don't have a clue how I can make it any more elementary than that. |

I took the memory card to the CCRB and gave it to the supervisor there. She says she'll give it to the investigator, who will call me back. Presumably, they'll be able to recover the photos, along with the key video of me recording the officers' badge numbers for the first time. Since the first (deleted, can be recovered) recording is time-stamped, and the second recording is also time-stamped, this will help back up my case, if not as well as time stamped delete information. |

Yes, it's another post relating to the cop incident at the end of this past April. (You can always click for the OP if you don't remember what I'm talking about.) Shortly before leaving for vacation, I called Investigator Cody from the CCRB, asking if they were finished with the memory card. (Quick recap: The cops deleted my photos; I had recorded their badge numbers, and they deleted those too. I re-recorded them. Since both the re-recording and the (undeletable) original recording were time stamped, this would support my complaint.) He said that they weren't. I said that I would be out of the country for two weeks on vacation. Several days ago, I left him a message asking if they were done. Yesterday, he called me saying that he wasn't sure of (actually "couldn't disclose" were his exact words) the undeletion status. Today, he called again, saying that the card was "supposed to" have been done today, but they weren't doing anything to the card in-house, and he couldn't reach the supervisor at the agency which was performing the undeletion. He said he'd call on Monday, and that the card should probably be done then. Investigations take a long time, it seems. Hopefully, there'll be enough evidence in the card to back up my complaint, but more-hopefully, I'll get my photos and videos back, since some of them are impossible to retake easily. |

Heh, no one deletes my RFW video of the (J) train leaving Broadway Junction and crossing the entire main line and gets away with it! Actually, not much dedication is required. I haven't missed a single new event, so the lack of posted updates should give you a good idea of how slowly these things go. The main thing is that I don't want a cop who is willing to violate the fourth amendment patrolling anywhere. Her casual remark: "You can't prove I deleted them" seemed to suggest (to me, and also a couple other people I told the story to) that she was used to breaking the law. There's no excuse for illegally damaging someone's property, but if she was indeed used to doing things like that, it's especially important that she's either corrected or fired. One other (minor) update: Investigator Cody said that they may not be able to release the undeleted pics to me. I can't see why that would be the case; I'd understand why they wouldn't release evidence used in an investigation, but these pictures are my property, and I've already seen (most) of them on the camera's screen. Hopefully, I'll be able to get the recovered pics back. If not, I actually considered going to small claims court and suing the individual cop who deleted them for the $30 cost of an undeletion program for my own computer so I can recover them myself. Dragging her into court and making her pay for the damage she caused, however minor it may be, would be a good way to make sure she thinks twice before violating someone's property rights! Incidentally, as a result of that incident, I am now taking matters into my own CCD and leaving the camera on during any and all encounters with cops in the subway. With a video camera running the whole time, there's no way a cop could delete anything and get away with it! Even if a cop takes the camera from me and turns it off, I'd still have a video of him/her reaching for and taking the camera, which is illegal without probable cause and would give him/her some splainin' to do. It also means that, unless the cop goes so far as to delete stuff or take the camera, I can email entire videos of cop incidents to someone I know who was a former cop and a former CCRB board member. The most recent cop incident (and the only one since "the big one") was a couple days ago, at 145th Street. (This was relatively shortly after a non-cop incident at Times Square.) Although I could make the argument that I was detained illegally, this one wasn't nearly as bad as the last one. Unfortunately, the video is eight minutes long, and Photobucket wants it to be five minutes or less. :( |

Yes, this is a month-old necropost in a thread originally started at the end of April and raised from the dead several times. It was either that or start a new thread on the same topic, and either one probably violates some rule of message board etiquette, which doesn't seem geared towards describing long drawn-out processes like the filing and investigation of a complaint of police misconduct. Anyway. I stopped by the CCRB today on my way to a birthday celebration to pick up the memory card. They had, it seems, recovered most of the deleted photos, if not all of them. I didn't ask specifically about the first recording of the cops' badge numbers, which was the primary evidence I hoped they'd uncover. When I got the memory card back, I found that it didn't have any of the pics on it, although they were obviously not overwritten. Investigator Cody said that strict nondisclosure policies at the CCRB prevent him from releasing the photos to me. I said that since the photos are mine, taken by me, submitted to them by me, and available to me with an undeletion program of my own, I didn't see why it was a problem to release their copies out of convenience. He said I'd need to talk to his supervisors about it. He also said that if I called him, he'd give me details on how I could get my own undeletion software, but I've already looked; it costs about $30, and the selections for Macs are limited, but existent. If I have to pay to recover them, I may pursue civil action to recover the costs, but I'd have to consult with the lawyers in the family. He also said that I should expect a letter relatively soon, though I don't know exactly what to expect in it. Updates will be posted as events progress, unless everyone gets sick of hearing about this and doesn't really care about the outcome. |
