I'm guessing its where you photograph is the issue. For instance, when I went to Knoxville TN and took pictures of the bus fleet, I was fine outside of the Bus Station. It seems that they don't mind pictures but they would ask why.
If for example a bus was running in the street on its route you could take a picture of it but you couldn't inside the garage unless you were a employee. The same with PATH. Any stop BUT WTC is ok but don't spend too much time taking pics.

No, that's not it at all. Amateur photography is not legally restricted in any publicly accessible area of any U.S. transit system where you are otherwise allowed to be except at the Pentagon station of the DC Metro (DoD imposed restriction) and on PATH (but the PATH restriction might not stand up to legal challenge - someone would need to test it).

Though not really a "public transit system" Greyhound does prohibit photography in/at their bus terminals... after getting yelled at I was all set to write an angry letter to Greyhound, when I found the actual rule prohibiting photography of "facilities, equipment or procedures" (or something to that effect).

Greyhound has more of a claim to being a private company than the Port Authority does, but even they can't prohibit photography of their equipment, facilities, or procedures, unless they're using a secret network of entirely private roads not visible from sidewalks, bridges, or nearby buildings.

Well yeah. Still, their rule impacts arguably the most common travel related picture taken: the picture of your vehicle at the stations you disembark. I've taken pictures of the train in the station and the plane at the gate, but I guess the bus at the privately-owned curb is a no-no.

Are the "police" of private railroads legally police officers? I would think they are just private security guards, and that calling them "police" is simply a colloquial usage, not their true legal status.

Nilet's basic contention that "If you're public enough to have your own police department, you're public enough to be subject to be subject to the first amendment" HAS to be true with regard to public "authorities". If this really has never been established, then someone needs to take a case to the Supreme Court to get it established. Otherwise, government could just offload most of its functions to various quasi-private "Authorities", and the Bill of Rights would become essentially meaningless. I certainly wouldn't want to live on a street "owned" by the "New York City Street and Sidewalk Authority", for example.

That would depend on the state. In NY, they are covered under the relevant sections of the NYS CPL, and NYS Railroad law. That is where their police powers are derived/defined. I don't know the answer outside of NY.

Actually, yes, Railroad police officers are fully empowered law enforcement officers.

Nielt's contention that in order to be a police department, you must be publicly accountable is false, there are private policing agencies.

From the wiki article on Railroad police:
Section 1704 of the U.S. Crime Control Act of 1990, provides that: "A railroad police officer who is certified or commissioned as a police officer under the laws of any one state shall, in accordance with the regulations issued by the U.S. Secretary of Transportation, be authorized to enforce the laws of any other state in which the rail carrier owns property."

Some states give railroad police officers full policing powers (IE if they see you robbing a 7/11, they can arrest you) while other states their powers are limited to the property of the railroad that employs them.

Here is the law for New York It notes that a Railroad police officer in New York has all the authority of any other police officer, within the property of the Railroad.

But as noted in the above quote, If you are a Railroad policeman, you have at least some authority in any state your Railroad owns land in.

Wow. A railroad company (or steamship or "express" company) can simply have anyone they want appointed a policeman, as long as he doesn't have a criminal record, and let him get training later? But the superintendent of state police can revoke or suspend that appointment "at pleasure", without giving a reason? It seems like this law gives people way too much power.

In practice, you want anyone with police powers and a gun to have their training ASAP. The liability issues if they are involved in an incident and have not yet received at least the minimum level of training proscribed for that position would make it most foolhardy.

As I read the law you posted, firearms training does have to be given before the officer is issued a gun, but other aspects of police training can come up to a year after appointment.

yes, proscribed was definitely wrong, my bad.... they get 6 months to do firearms training, can work w/o gun before that....but would you but your business insurance at risk by putting someone out there who might arrest someone without the appropriate basic training....I would not be surprised if liability carriers list that as an exclusion, and would not cover...

Strictly speaking, anyone can be made a law enforcement officer with no formal training at all.

For example, outside of New York City, the office of County Sheriff is an elected one.

(NYC's Sheriff is a political appointment by the mayor who oversees a Sheriff's department with 150 deputies who mostly handle court ordered seizures, but still have policing powers).

In NYC the Sheriff and Undersheriff positions are appointed, but the deputies are civil service. Most sheriff positions in NY include both law enforcement and correctional responsibilities and are classified as "police officers" NYC is somewhat different, they are "peace officers" but obviously, we have both a large police force and dept. of corrections.

If you have police powers, you are required to obey Constitutional restrictions no matter who you are and who you work for— the rights granted by the Constitution represent limits on the power of the state, and the state cannot delegate to any person a power that it doesn't have itself.
