Are the "police" of private railroads legally police officers? I would think they are just private security guards, and that calling them "police" is simply a colloquial usage, not their true legal status.

Nilet's basic contention that "If you're public enough to have your own police department, you're public enough to be subject to be subject to the first amendment" HAS to be true with regard to public "authorities". If this really has never been established, then someone needs to take a case to the Supreme Court to get it established. Otherwise, government could just offload most of its functions to various quasi-private "Authorities", and the Bill of Rights would become essentially meaningless. I certainly wouldn't want to live on a street "owned" by the "New York City Street and Sidewalk Authority", for example.
