If you are speaking of detainees at GITMO, USA laws need not apply at all.

The Geneva Convention specifies how to deal with prisoners of war. It further specifies that un-uniformed combatants may be exicuited upon capture. THAT IS WHAT INTERNATIONAL LAW permits. That we did not do so was an act of mercy, yet we do retain the right to detain them until said combat operations are concluded and peace treaties are in place which will specify how to deal with them.
