Civil rights, OTOH cannot be taken away by the legislative process.Yes they can. Only civil rights that the courts find are inherent in the Constitution cannot be taken away by the legislative process. Congress could, if it chose, overturn the Voting Rights Act of 1965. Of course, public opinion would preclude this from happening, but that's the only obstacle. |
