In your case, you can fight it, but if the officer shows up to testify, your chances of winning may not be very good, as the NYC Transit Authority rules are very explicit, even at terminals. Since the car doors were open, the officer could claim one could have walked down the platform instead...assuming there wasn't ice, or the car wasn't burning hot.Your best hope is to hope the officer doesn't show up. |
