The problem is the intent of the law is virtually never taken into consideration by cops when they enforce the law.A couple taking pictures in Times Square might get by simply because of the sheer quantity of people taking pictures there, but cops could use this law against for example, an amateur photographer and his girlfriend waiting for the sun to set over the Brooklyn Bridge to get the shot of a lifetime.... The city has a track record of lying when it comes to enforcing laws. Like someone else here said the city originally said that the recycling laws would only be enforced against flagrant violators yet even minor violations are being ticketed now. Last year some cop decided to enforce a parking rule that virtually no-one on my block ever heard of - any car that did not have its front wheels turned at an angle was ticketed. I believe automatic transmission made that rule obsolete years ago... Fortunately angry calls to Vallone's office got the tickets dismissed - still it was a hassle! There are many other examples of cops using obscure laws whenever they feel the need arises... So if they want to stop someoene from photographing whatever they feel should not be photographed all they would have to do is watch the clock and invoke this law... |
