GOP Rep. King Introduces Bill To End Birthright Citizenship

Rep. Steve King (R-Iowa), one of Congess' biggest xenophobes, has introduced a bill that would effectively gut the Fourteenth Amendment's guarantee of birthright citizenship. King's proposed law, based on his view of the Constitution, is aimed squarely at children of undocumented immigrants who are born here.

The Fourteenth Amendment holds that "all persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside." Over the years, the Supreme Court has reaffirmed that definition many times, even ruling that the immigration status of a US-born baby's parents are not an issue with regard to the citizenship of the baby.

Further, US policy holds that a baby born on a ship in US waters, or on an airplane flying over US airspace, even if the plane never lands in the US, is an American citizen. (All Mommy or Daddy has to do is file for a birth certificate from the state over which the baby was born).

But, hey, the Constitution isn't an impediment to our GOP friends, now is it?

Still, introducing a bill to gut a Constitutional Amendment is not what we need from members of Congress. King's bill is clearly aimed at the growing political influence of the Latino community.

He's trying to limit future minority votes by denying birthright citizenship to future potential minority (i.e., mostly Democratic) voters.

You're underestimating his intelligence. He knows perfectly well that his bill will never become law, and that it will further alienate Hispanics from the Republican Party. But it will do that which is most important for him. It will make his own seat more secure.

Didn't Jose Serrano (D-N.Y.) just introduce a bill abolishing term limits for the President? Does that bill not violate the Constitution as well?

The point was specifically made the Rep. King wasn't trying to amend the Constitution, he was just trying to pass it as an ordinary Act of Congress.

I'm not sure that a bill can do that alone---how is "subject to the jurisdiction thereof" interpreted? (You have to go by what's actually there.) To me, subject to the jurisdiction there means "jus soli". To change that is to change the meaning of Amendment 14---requiring an Amendment of its own.

"Subject to the jurisdiction of" means "the laws of the US apply to". Foreign diplomats are not subject to US laws (the example given in one of the links in my OP), so any children they have here are not citizens by birthright, AFAIK.

Xenophobe.

I was born in the US to a non-resident alien mother. If this were law, I would have been forced to move to a country that I have only ever visited for 4 weeks of my life and whose language I only speak poorly.

Meanwhile I have worked in the US for 40 years and still going strong. I've paid plenty of federal, state, and local taxes. You'd be happy if my contribution to the economy didn't exist.

This bill (which I nevertheless oppose) only requires that one of the child's parents be a resident alien.

There are people who want to abolish birthright citizenship to children born to people neither of whom are citizens. If that were the case, I'd have been born stateless.

OK, then I guess I would have squeaked in - my father was a resident alien - he got his green card a few months before I was born. So I suppose then I should be fine with the bill. :)
