It is a sad state of affairs.

While I'm pro death penalty (because creatures like these need killing), I believe the case should always be airtight. In an age where you have DNA testing, there is no reason it should not be required where relevant in capital cases. The prosecution should have an airtight case to get a death penalty conviction.
