I can agree with that in certain limited instances. Burning a cross on someones lawn is worse than littering and trespassing. Breaking into a synagogue and trashing it with antisemitic graffiti is worse than regular graffiti and trespassing. Those are attempts at intimidation and are premeditated. But when it comes to adding a hate crime charge on top of assault because one or more people yelled racial epithets during a fight or attack is going too far. |
