The purpose is to add extra punishment because of why the crime was committed, not because of the crime itself. We should punish the crime, not the "why".It is well known that the most common hate crimes are simple assaults used to instill fear in the targeted group. In the criminal justice system, simple assaults usually get no more than a slap on the wrist with some probation, etc. That is not sufficient to deter what amounts to terroristic intimidation of the targeted groups. That's why hate crime laws are necessary. |
